SHERA PAGLINAWAN, ET AL., V. JAMES FREY, ET AL. January 30, 2006
Readers of James Frey's book, A Million Little Pieces, have filed suit in federal court in Seattle seeking class action status based on allegations of breach of contract, unjust enrichment, misrepresentation, and violation of the Washington Consumer Protection Act. The suit was filed against Frey and his publisher after Frey disclosed that much of this book, sold as a memoir, was fabricated.

why didn't they just return the book to the seller, who in turn would have to deal with the publisher who apparently
didn't proof read the book or didn't care it was BS.

Tort reform indeed. This is so risible it hurts to ponder it. A self-absorbed professional victim embellishes his resume in the form of a novel masquerading as a non-fiction. His readers, connoiseurs of victimhood, feel victimized, and mount a class-action suit to press their claim. This is special interest politics at the level of the personal: MY pain, MY affliction, demands that YOU redress it.
A product of the times I suppose.

THE DEATH OF IMAGINATION, is what the cat calls it. Everything must be "based on a real story". The Hollywood ghouls gave us film biographies of Ray Charles and Johnny Cash the very years these two died. There was, in my opinion, more truth in the fictional movie Payday with Rip Torn than in either of those two. Frey tried to sell this book as a novel and failed, but as a "true story", hey, how inspiring, how uplifting! The only fiction that sells are silly fantasies like Hairy Potty or Star Trek Wars with a singing Captain Kirk: Luuuuuucyyyyyy!

1.5 As a result of the Defendants actions the Plaintiffs have suffered economic damage. Did you enjoy the book? Good, no damage done, you received the entertainment you paid for. Did you not enjoy it? Then sue the author of every book you didn't like.

Authors still write fiction. The problem is that they write more fiction than ever, and more fiction gets published now than ever, so much so that reviewers and critics and even the most voracious readers can't keep up with it, so much so that to differentiate yourself from every of author of your class or genre is almost impossible. This is why the non-fiction market offers the only growth opportunties in publishing. The market is glutted like never before in history.
The imagination is not dead. In an age that rejects the notion that art must serve a higher purpose or any purpose at all, imagination is
everything: imagination is the victim of its own success.
