The U.S. Patent and Trademark Office (PTO) has issued a non-final rejection of a fifth patent in NTPs lawsuit against Research In Motion (RIM), according to a lawyer for NTP, Reuters reports.
Research In Motion is the maker of the popular BlackBerry handheld, and the case could lead to a shutdown of RIMs U.S. sales and services.
The PTO has currently issued non-final rejections of all five patents in the BlackBerry infringement case, currently pending before a federal judge, the article says.
James Wallace, an NTP attorney, said the company has the opportunity to respond within 30 days, after which the PTO will render a file decision, Reuters reports. That decision could be brought before a patent appeals board.
I understand that RIM was willing to settle with NTP, as long as their patents were held valid. I guess that NTP couldn't accept that offer since it would mean they wouldn't get any money out of their patents.
Does that mean that Blackberry owners get refunds?
It means Blackberry is in the clear.
This company has been extorting dollars from a variety of companies for some time.
It will be nice to see a stop put to their games.
Who was these guys lawyer? David Boise? LOL!
Perhaps NTP chose poorly, when they turned down the settlement offer.
