I agree. If Alito thinks that lethal injection might be "cruel and unusual" then he likely is against the death penalty period. This doesn't bode well for law and order.

I'll reserve judgment.... for now. This decision doesn't say that lethal injection is cruel and unusual; only that the con will get his chance to make that argument. If he wins, and the supremes uphold it, then I'll be watching Alito's vote very carefully.
