Fitzgerald's Smoke and Mirrors

Here is a sample of the sort of self-serving hooey the Special Prosecutor dished at his press conference following the indictment:

FITZGERALD: The fact that she was a CIA officer was not well- known, for her protection or for the benefit of all us. It’s important that a CIA officer’s identity be protected, that it be protected not just for the officer, but for the nation’s security.

It’s a far cry from his January 9 response to Libby’s counsel, responding to a discovery request (Exhibit B to Libby’s last filing):

The Special Prosecutor has no evidence that national security was harmed or that Plame was a "classified employee".He never even sought such evidence.

Request E We have neither sought, much less obtained ‘all documents, regardless of when created, relating to whether Valerie Wilson’s status as a CIA employee, or any aspect of that status, was classified at any time between May 6, 2003 and July 14,2003’

If he had no such information, how could he proceed with an investigation about a breach in laws regarding National Security?

The referral from the CIA ASKED the DOJ to see if there was a violation of law. They couldn't make a determination on their own. So it was Fitzgerald's obligation to make that determination BEFORE proceeding.

And if he had no such information and therefore could make no such determination, how was it legal to send FBI agents on a fishing expedition to interview White House employees and ask for WH emails and other docs?

Fitzgerald clearly made a mistake by not establishing that leaking Plame's identity was a crime. It was irresponsible for him to procede with a federal investigation into who leaked without first determining whether leaking was a crime. Looks like the whole deal was an entrapment.

I'm beginning to think Mr. Fitzgerald needs more law schoolin' training before he starts making a case. Looks to me the dude hasn't crossed all of the "T''s or dotted all of the "I"'s. Mr. Libby has to be happy as the Fed's case is imploding right in their faces, and they can't stop it. Libby's lawyers haveto be salivating for this one to go into court. It will be wonderful to see how the MSM pretty boys and girls answer little questions like..."Who did you talk to on July 30, 2004 and what was the discussion about?" I couldn't tell you what I was doing on that date, nor even care, but Fitzgerald has based his case on this kind of b.s., and that's why it will explode on him.

I think he was just being "inventive". I don't think he was on the take. I don't think he realized he was being played by Wilson and the press.

But I do think he's on the line--of not over--of prosecutorial misconduct.
