"Actions are criminal, not insults."
According to the article, the woman cursed and banged on the window. That's enough in many jurisdictions for a breach-of-peace arrest, regardless of the race/ethnicity of the recipient. As for the charge of "ridicule on account of race ...", however, that sounds like political correctness run amok.

Byrd's supervisor told police that Byrd should not have been working the drive-through because he had gotten into a similar incident with another customer, the warrant states. Perhaps Byrd should have been fired the frist time, then this one wouldn't have happened. What ever happened to "the customer is always right?" I think I'd be going to Taco Bell's parent company over this.

In Santa Monica the local paper's crime blotter reports suspects color of hair, color of car, color of shirt, color of tattoos, color of pants, color of hat, but NOT color of skin

I was beginning to think this article is bogus, because there's no way a state could actually make this illegal, but in fact,
here it is, in black and white:
"Sec. 53-37. Ridicule on account of race, creed or color. Any person who, by his advertisement, ridicules or holds up to contempt any person or class of persons, on account of the creed, religion, color, denomination, nationality or race of such person or class of persons, shall be fined not more than fifty dollars or imprisoned not more than thirty days or both.
(1949 Rev., S. 8376.)"

Jennifer Farrelly, 19, of East Windsor, has been charged with ridicule on account of race, creed or color and second-degree breach of peace. "ridicule on account of race, creed or color and second degree breach of peace"?
HUH?
Most rap music falls into this category...especially the breach of peace part.
