AUSTIN, Texas (AP) -- Prosecutors investigating former House Majority Leader Tom DeLay on felony conspiracy and money laundering charges are seeking bank records for the Texas Republican Party.
District Attorney Ronnie Earle issued a subpoena Thursday ordering Frost Bank to produce monthly statements and signature cards from August 2002 to January 2003 for accounts connected to the party or the Texas Republican Congressional Committee.
DeLay attorney Dick DeGuerin said the subpoenas are not enforceable because the charges are still under appeal.
"There's no setting, no trial, nothing that can be enforced," DeGuerin said. "Whoever gets (the subpoena), they can wad it up and throw them in the trash can."
A telephone message left with the Republican Party was not immediately returned.
DeLay and two associates are accused of funneling $190,000 in corporate contributions through a political committee and an arm of the National Republican Committee to seven GOP legislative candidates in the November 2002 general election.
Republicans that year took control of the state House, leading to a redistricting plan that also allowed the GOP to win a majority of seats in Texas' congressional delegation in 2004.
Earle contends DeLay and his associates tried to circumvent state law barring spending corporate money on most campaign expenses.
DeLay, who is running for re-election, awaits trial on the felony charges and denies any wrongdoing. The indictments forced him to give up his post as majority leader.

Boy this is a sure sign Earle has a rock solid case against DeLay with his frantic Witch Hunts after he has already indicted DeLay. I am actually beginning to feel sorry for Earle.
