I've had arguments on other forums with Germans and other Europeans about similar releases. They are unabashed about this. If the accused faces a possible death penalty in the US, they will release him and even help him get away. They consider their judicial/penal system to be superior to our comparatively 'barbaric' one. Thus they have no problem handling the trying and sentencing for crimes that did not occur on their soil and did not involve their nationals.

The Germans will give over people to us according to our extradition and SOFA (for US troops) treaties, only as a condition of the handover we have to promise not to seek the death penalty.
