April 7, 2006 -- IMMIGRATION-BILL SURPRISES HOW do you slip legislative poison past a U.S. senator? Bury it on page 302 of a bill.

The Senate's Democratic and Republican leaders yesterday announced a compromise on an immigration bill - with some details still to be worked out. But details that may continue from the bill passed out of the Judiciary Committee should definitely be deal-breakers.

Like that surprise hidden on page 302 - which would replace the country's entire bench of experienced immigration judges with pro-immigration advocates.

With a few exceptions, today's immigration judges (who serve for life) are dedicated to enforcing the law, and they do a difficult job well. This bill forces all immigration judges to step down after serving seven years - and restricts replacements to attorneys with at least five years' experience practicing immigration law.

GREAT POINT!


Congressman Tom Price (R- from GA) is trying to pass a bill that would require that ANY additions to bills have a "credit" line added- so we don't have to do ridiculous research to find out who adds the pork and crud.

I say it is a GREAT idea.. if you want to add things- you should have the balls to put your name on it!

...The third nasty surprise lies in what the bill fails to do. The measure envisions a massive amnesty for illegal aliens now in the country - but doesn't give the Citizenship and Immigration Service (CIS) the personnel or infrastructure to implement the amnesty.

In March, the General Accounting Office (GAO) issued a scathing report on the CIS's inability to effectively detect immigration fraud.

The last time we enacted a major amnesty, in 1986, the Immigration and Naturalization Service (the CIS's predecessor agency) processed some 3 million amnesty applications from illegal aliens. It found 398,000 cases of fraud - and missed thousands more. Now CIS may have to implement an amnesty four times larger.

Yet CIS already faces a backlog of several million applications for immigration benefits. And the GAO found that CIS managers pressure staff into "meeting production goals" by approving applications quickly - which means that fraud goes undetected. Adding millions of amnesty applications can only make things worse. And the latest Senate "compromise" - giving immediate amnesty only to aliens who've been in the country for five years or more - makes the process even more complex and fraud-prone, as illegals use fake documents to "prove" long-term residence.

In 1986, the terrorist Mahmud "The Red" Abouhalima fraudulently got amnesty as a seasonal agricultural worker (in fact, he was a New York cabbie). That status allowed him to travel to Afghanistan for terrorist training - which he later used as one of the 1993 World Trade Center bombers.

Terrorists know how to game the system. Janice Kephart, former counsel to the 9/11 Commission, released a study last year on how easily terrorists obtain immigration benefits. Of 94 alien terrorists in the United States, she found that 59 were successful immigration frauds. That includes six of the 9/11 hijackers.

The Senate bill does nothing to address this problem - while throwing a massive new load on the bureaucracy. A new amnesty will almost certainly ensure that more terrorists gain the legal right to walk our streets.

They will no doubt show their appreciation by attacking innocent Americans. And that will be the nastiest surprise of all.

The second nasty surprise? Just before the committee approved the bill on the evening of March 27, Sen. Richard Durbin (D-Ill.) offered the "DREAM Act" as an amendment. It passed on a voice vote.

The DREAM Act is a nightmare. It repeals a 1996 law that prohibits state universities from offering in-state tuition rates to illegal aliens. The principle, of course, is that no illegal alien should be entitled to receive a taxpayer-subsidized benefit that out-of-state U.S. citizens can't get. But the committee's bill allows illegals to be treated better than those U.S. citizens on tuition.

Tony Snow, Laura Ingraham, Hannity, someone needs to get this man a microphone so he can tell the American people about this.

Understand. But even if he (himself) wrote it - and I didn't get that impression from the text), he couldn't stick his language in the bill.

Somebody else, somebody on a Senator's staff/committee staff, had to put it there.

Now, how many other "little" unnoticed things get stuck in 500 + page "bills" to support just one client. Er, lobbyist.

In spite of the collective outrage of a very strong majority of Americans, the way Washington is attempting to address illegal immigration just gets uglier and more deceitful.

I used to just think that a large portion of GOP senators were just arrogant. That something like this got so close to a vote leads me to believe that they may be mentally deficient as well.

I cannot possibly fathom how any of them cannot see the writing on the wall should they pass legislation with these types of provisions.

I have been reading a lot about the immigration problem on FR for quite some time now...and I was thinking after reading some of the bonehead ideas from our politicians if it wouldn't be fruitful to require everyone who is elected to the Senate or Congress to take a course on the Constitution and study about the founding father's intent when they wrote it. For that matter I think it should be required curriculum in our schools. I, too was under the false impression that anchor babies exist and are citizens until I actually read some of the articles here.
The average American citizen is probably under that same false notion....because they were never taught the truth.

The Bible has a scripture that says "my people perish for lack of knowledge" this of course is talking about God knowledge. But the same holds true for the average hard working American. If they do not know what is in the constitution itself...then anyone with an agenda can get into Washington and make any law they feel like...be it Constitutional or not. Without knowledge of the Constitution, we are like sheep to the slaughter.

(sigh) Just makes me wonder where we are heading.....

Senator Coburn was on KFAQ this morning and had some notable things to say. He said the immigration reform bill as it is will be killed today in the Senate. That the border needed to be secured first. I hope he is right. Time will tell.

Just when you think there can't be any worse news that involves allowing the illegal invaders to stay, there's more bad news.

And if truth be known there are probably more things we aren't aware of.

Here's what should happen, the American people deserve to know ALL the gory details because it affects ours and the lives of our families, we should be able to vote on each and every proposed amendment in a special election BEFORE any of this garbage is passed.

I STRONGLY oppose letting illegal aliens even ATTEND my state universities, much less qualify for in-state tuition.

AND because of that, I would fight to get this provision out of the bill.

HOWEVER. I feel hypocritical. Because the bill does not REQUIRE states to provide in-state tuition for illegals, it merely ALLOWS them to do so. Each state legislature would then make the decision.

I'm not sure why I, as a limited-government conservative, wouldn't support measures which pass decision-making down to the states. In general we like to do this, and only get involved when a state law could impact other states adversely (like gay marriage).


What would you all say to assuage my guilt on this matter?

Think that allowing illegal invaders into this country "to do jobs Americans won't do" isn't as bad as terroism? I would say that when it comes to matters such as illegal aliens that the states should not have any ability to make self determinations.

Immigration into the republic is a matter for the feds and the feds alone.

In an instance like this it would only take California delaring it unconstitutional to not give them in state tuition to have that cascade into states that did not grant it and did not want to.

That's reasonable.

The argument for providing illegal aliens in-state tuition of course is that the children have met the "residency requirements", and we shouldn't punish them for the crimes of their parents.

Also, since we know that attending college will make people more productive citizens, we might have a vested interest in educating them.

My response is that whe the college is rejecting in-state legal residents because they don't have money or room, we shouldn't be letting in illegals.

The crazy lady from Rush's program yesterday might instead argue that if we let illegals go to college, they'll be as uppity as americans, and we'll have to get a whole knew batch of illegals to come to the menial jobs we are too educated to do.

(If you didn't catch her, she argued we needed illegal immigrants because 30 years ago 43% of us didn't have a high school diploma, and now it was only 9%, so we didn't have enough ignorant people for the unskilled jobs).

Does anyone have the bill number for this or know where we can read the bill and its amendments?

I found the following from a McCain Press Release dated April 6, 2006.

Senators McCain and Kennedy first introduced The Secure America and Orderly Immigration Act of 2005 in May 2005. The bill was a bipartisan, bicameral, comprehensive border security and immigration reform bill cosponsored by Senators Brownback (R-KS), Lieberman (D-CT), Graham (R-SC), and Salazar (D-FL), and in the House by Congressmen Kolbe, Flake and Gutierrez.
Doing a search for The Secure America and Orderly Immigration Act at thomas.loc.gov turns up S. 1033, but that hasn't been updated since May 12, 2005.

You're response is reasonable as well, if Amercina citizens are getting denied illegals should nt be going at all.

I heard about her, typical wall street liberal, doesn't want to have to do her own housework but also doesn't want to have to pay anyone above slave wages.

She's as big a scum as the illegals she employs.

The sad thing is that most of our Senators probably don't even know this is in the bill. Not that they'd necessarily even object if they did...

They crafted this thing with five people at midnight and everyone was just to get in line in matter of hours and endorse it. Pathetic.

And they wonder why the American people aren't inclined to discuss what to do with current illegal immigrants and future immigrants? It's because they (rightly) do not trust D.C. has any interest in securing our borders. And this is further proof.

Borders first.

THEN we'll talk once they've established their sincerity.
