There are successful prosecutions without chemical evidence - particularly when you go on TV and admit you were on drugs and then witnesses turn up that you were drinking.

Note to self: Follow-up on this in one year and see if anything came of it. Check to see if this clown gets reelected. I think I already know the answers.

I agree that this will be prosecuted, and after the Courts make it mandatory that he stay dry and free from drugs,alcohol he will finally get the help he so badly needs. I disagree with those that say that the average citizen does not get these kind of breaks, because sometimes they do. The reason is that "there for the Grace of God go I" mentality in the average Police Officer,even if they are by the book. When they are off duty, some get wasted just like John Q Public. They are not supposed to drive the guy or gal home though,send him in a Cab or call someone to pick him up. The fact that he almost hit the police Car and hit something else and was driving too fast with his lights out should have gotten him busted right then no matter who he is. I have called Cabs for Officers that wanted to give a guy a break,only to have to run a history on the drunk who comes back to pick up his car that the officer made him park and got caught trying to drive it away. Really stupid on both parts.
