'Tears' as Alleged Duke Rape Victim ID'd Suspects

Two members of the Duke lacrosse team have been indicted. A third lacrosse player, also accused of rape, could be next.

Details of the case remain clouded in controversy, but today it became clear how the alleged victim singled out Reade Seligmann and Collin Finnerty as the men who had attacked her at an off-campus party on the night of March 13.

On Wednesday evening, Durham's WRAL-TV released a transcript describing the photo lineup in which the alleged victim picked out her attackers.

The woman, a 27-year-old student at nearby North Carolina Central University, was shown 46 pictures, covering every white player on the men's lacrosse team. As the lineup began, the alleged victim was asked to "merely … look at each picture and see if she recalled seeing the individuals at the party."

Police also asked her to detail "what they were doing and any type of interactions she may have had."

When she saw the picture of Finnerty, her emotions were overwhelming. According to the investigator's notes, her "eyes were pooling with tears" as she described in graphic detail how Finnerty had allegedly raped her.

When the defense comes out with video footage showing the suspects elsewhere, it will hopefully result in an extreme embarrassment for this moron of a DA. And he should be made to cover the state's costs and the suspects' attorney's fees from his own personal pocketbook. He caused all this lunacy, after all.

Hmm, let's see here. She was shown 46 pictures of all the white players at this party and she only recalls seeing two of them?

Has anyone seen a picture of the bathroom?

It's been a LONG time since I saw a bathroom that would hold four calm sober people, let alone three drunk guys and one possibly drunk stripper.

Now that the 'authorities' in Durham have arrested the cab driver who will testify on behalf of Seligmann, it seems that desperation is setting in.

They can qualify their actions with all the 'merely's they want. The charged these students and then went out look for evidence.

Something disgustingly wrong here.

If they are not convicted, shouldn't they file a wrongful suit against her and her sponsors!!

I'm beginning to suspect that all he had time to do was insult her "character" in a racially derogatory way. This is sounding more and more like (a) a ploy to get out of a public intoxication charge with (b) a revenge element that (c) got out of control. But the facts will come out.

Normally a prosecutor is immune from lawsuits. However, that only applies to situations concerning decisions as to whether to file criminal charges. In Nifong's case, he has been actively involved in the investigation. that being the case, and especially if he filed an affidavit in the case; he would be personally liable for civil rights damages.

Malicious prosecution is pretty difficult when the prosecutor gets a grand jury to indict.

There is no way this photo line up should be allowed.

A true line up MUST include guarantee non-participants.

The fact they gave her a 100% chance of randomly selecting "all the rich white lacross players" negats it.

If anything the one person with the documented alibi torpedoes the whole case.

(I still think this prosecutor should be disbared for playing the political game with people's lives)
