Ex-Solicitor General to Help Skakel Appeal

HARTFORD, Conn. (AP) - A former U.S. solicitor general will help Kennedy cousin Michael Skakel appeal his murder conviction to the U.S. Supreme Court, saying Monday the case will focus on when the charges were filed.

Theodore B. Olson has argued 43 cases before the nation's highest court, including representing George W. Bush in the disputed presidential race of 2000.

Prosecutor Jonathan Benedict said he would be surprised if the U.S. Supreme Court agreed to take up the case. The court generally agrees to consider cases that have a wider impact, he said. ``This is a one-of-a-kind case,'' Benedict said.

Silly guy. Those kind of rules don't apply to the special people.

Olson: "I am, your honor."
Judge: "Counselor, are you aware that Ambien was not yet invented at the time of this murder??"
Olson: "I am, your honor."
Judge: "Well. Just so we're all clear. All charges are dismissed. Mr. Skakel is free to go."

I love Ted Olson. He is a patriot. I was heartbroken when I heard Barbara died on 9/11.

The question is whether change of statute of limitations period prior to expiry is an ex post facto violation. It is already SCOTUS law that a change of statute of limitations where the period expired is a violation.

The Connecticut General Assembly eliminated the statute of limitations for murder in 1976. The state Supreme Court ruled that because the Moxley murder occurred within a five-year window of that legislation, the change applied to his crime.

Skakel's attorneys argued that the decision violated his due process rights under the U.S. constitution by retroactively applying the law.

This is actually a good argument. As much as I believe Skakel is guilty, the statute of limitations had expired.

On the other hand, if the state could establish that he wasn't prosecuted within the statutory time limitation period because the crime was being covered up by the cops and DA at the time because of political connections, the statute of limitations may be tolled. If so, the statute of limitations may not be a problem.
