Stop Illegal Aliens In W.Va., Ohio
Wheeling News-Register ^ | May 24, 2006

Posted on 05/24/2006 12:10:07 PM PDT by SwinneySwitch

Ohio County Sheriff Tom Burgoyne at times has been outspoken in his criticism of federal immigration enforcement officials. In the past, Burgoyne has been known to complain that his deputies were told by the Immigration and Customs Enforcement Service to simply release illegal aliens — because the federal agency didn’t have the resources to deal with them. During recent months, however, ICE officials seem to have been more cooperative.

But the time may be coming — soon — when Burgoyne will be told that his department simply isn’t allowed to apprehend illegal immigrants. The new message from ICE, backed by the American Civil Liberties Union, seems to be that local law enforcement agencies need to adopt a hands-off attitude toward illegal aliens.

Another sheriff who in the past has been critical of ICE ran afoul of the agency last week, after his deputies apprehended 18 men who admitted that they were illegal aliens. It happened in Butler County, Ohio. There, Sheriff Rick Jones released the 18 men, after questions arose concerning whether his department had any authority to arrest them in the first place.

Richard Wilkens, resident agent in charge of the ICE office in Cincinnati, told The Associated Press that local law enforcement officers in most cases can arrest illegal aliens only if the subjects are charged with violating state laws. “If they arrested the individuals for being suspected illegal aliens, they don’t have the authority to do that,” he emphasized. Later, an official of the ACLU questioned whether Jones’ department had authority to arrest illegal aliens.

Good heavens. At times it appears that the entire machinery of federal government is aimed not at stopping illegal immigrants — but at giving them every break in the book. The ICE attitude toward help from local law enforcement agencies certainly seems to reinforce that perception.

Our message to Burgoyne — and any other local law enforcement officials who encounter illegal aliens — is to arrest first and ask questions about jurisdiction later.

And our message to state legislators in both West Virginia and Ohio is to examine the statute books to determine what state laws can be used to apprehend illegal immigrants. If existing laws prove lacking, legislators should enact new ones. Federal officials need to know that, even if they aren’t serious about stopping illegal immigrants, those of us in West Virginia and Ohio are.

Fine, clear the cells of illegals so there will be room for the ACLU and most of Washington.

That part of the Ohio river valley has a lot of gun owning, individual rights supporting citizens and illegal aliens may want to think twice about settling there.

Sounds a little like someone from Texas needs to prod the Dept of Homeland Security and ICE into being a tad bit more pro-active.

Don't you & I wish. The CLEAR Act was supposed to foment cooperation between the feds & local law enforcement with regard to inland enforcement, but the Bush Administration repeatedly stated that it supports state and local law enforcement only in certain "narrow" circumstances related to terrorism.

There are several ways out of the illegal morass. Aiding and abetting felons has consequences under US law.

FREEPER ACTIVISM: If the bonding agencies for tax-exempt state and municipal municipal transportation and highways, municipal school bonding, utilities bonding, and the like, are ignoring illegals' activities, they are violating their fiduciary responsibility. Ignoring blatant felonious activity could be construed as aiding and abetting. The SEC should be advised of your concerns. EMAIL enforcement@SEC.gov.

FREEPER ACTIVISM: Most bonding agents conducting state and municipal business are registered broker-dealers and members of the National Association of Securities Dealers (NASD) and the Securities Investor Protection Corporation (SIPC). They are violating their fiduciary responsibility if they ignore (or aid and abet) blatant felonious activity. They could be held liable and receive penalties. NASD and SIPC should also be contacted regarding your concerns.

FREEPER ACTIVISM: Banks doing tax-exempt bonding business with states and municipalities conducting illegals' activity are violating their fiduciary responsibility if they choose to ignore blatant felonious activity. They could be held liable for jeopardizing the financial interests of bank patrons, shareholders, and depositors and should be reported as follows:

The Office of the Comptroller of the Currency (OCC) is the primary federal regulator for national banks. The OCC's Customer Assistance Group is available to assist customers with questions or complaints concerning national banks. Email to Customer.Assistance@occ.treas.gov.

You can reach one of the OCC Customer Assistance Specialists by calling toll free number, 1-800-613-6743, Monday-Thursday, 9-4, and Friday 9-3.

PARTIAL LIST OF INVADERS' FEDERAL CRIMINAL FELONIES

1 - Use of illegal ID or documents
2 - Federal income tax evasion
3 - Re-entry into USA after deportation
4 - Obtain/Operate vehicles with illegal ID
5 - ID theft/fraud - Social Security fraud
6 - Knowingly gaining employment fraudulently
7 - Recruiting other illegal aliens workers
8 - Transporting illegal aliens
9 - Harboring &/or housing illegal aliens
10 - Undermining US national security
11 - Registering/Voting using fraudulent documentation
12 - Conspiracy to violate federal statutes
13 - Uttering false statements to public officials
14 - Obstructing law enforcement

FREEPER ACTIVISM: If duly elected government officials--and employees on the government payroll---are aiding and abetting illegals to break the law, to obtain the unlawful right to vote, and if illegals used phony documents to vote on tax-exempt bond issues, this might be a violation of the Hobbs Act.

If elected and appointed officals did, in fact, allow illegals to break the law by engaging in government activity, this could be a violation of the Hobbs Act.

If elected and appointed officials took campaign contributions from said illegals, this could be characterized as extortion, and/or bribery, and a violation of the Hobbs Act.

The Hobbs Act was used recently to nail four Tenn state legislators and their aids in an extortion scheme. The TENN groups was arrested under the federal Hobbs Act, charging extortion, conspiracy to extort and attempted extortion, and accepting bribes by an agent of the state. The Hobbs Act covers extortion by public officials, as follows: 2403 Hobbs Act -- Extortion By Force, Violence, or Fear

SOURCE October 1997 Criminal Resource Manual 2403 http://www.usdoj.gov/usao/eousa/foia_reading_room/usam/title9/crm02403.htm

9-131.000 THE HOBBS ACT -- 18 U.S.C. § 1951
9-131.020 Investigative and Supervisory Jurisdiction Primary investigative jurisdiction of offenses in 18 U.S.C. § 1951 lies with the Federal Bureau of Investigation. The Inspector General's Office of Investigations, Division of Labor Racketeering (formerly the Office of Labor Racketeering), United States Department of Labor, is also authorized to investigate violations of 18 U.S.C. § 1951 in labor-management disputes involving the extortion of property from employers by reason of authority conferred on investigators as Special Deputy United States Marshals.

Supervisory jurisdiction over 18 U.S.C. § 1951 is exercised by the following offices with respect to the offenses noted:

1. Extortion under color of official right or extortion by a public official through misuse of his/her office is supervised by the Public Integrity Section, Criminal Division.

2. Extortion and robbery in labor-management disputes is supervised by the Labor-Management Unit of the Organized Crime and Racketeering Section, Criminal Division.

3. All other extortion and robbery offenses not involving public officials or labor-management disputes are supervised by the Terrorism and Violent Crimes Section, Criminal Division.

How long before the Kennedy and Bush and Hagel and Martinez decide we have to send the army to the border...to invade Mexico and forcibly drag millions more into the country for cheap labor?

These people in Washington have lost their minds.

My liberal democrat NYC sister and most of her many friends and business contacts across the USA and abroad agree these laws should have been enforced and need to be strictly enforced to the maximum.

She wants a wall/fence, more BP, NG at the borders, instant deportations, conviction and imprisonment of all these crooked employers and politicians.

So much for all that sensitive PC horseradish.

Good to hear your realtime account.

At last----a unifying issue. Anti-invasion is a consensus issue that cuts across the entire political spectrum. May even end the PC atrocity once and for all.

I firmly believe Americans of all political stripes are getting tired of sicko hyphenates manipulating the political process, using the US government as an ATM to finance their various self-esteem problems.

As one astute FReeper posted: "Americans understand that they are being threatened with financial disaster, unemployment, lower standards of living, crime, backbreaking taxes, loss of liberty, and of civil rights, to name a few. All because of a burgeoning illiterate population, with racist, anti-American attitudes, and Marxist indoctrination to take over our country with the vote, and violence, if necessary. Americans are scared and angry."
