Photo Lineup made Public in Duke Lacrosse Case

The accuser in the Duke lacrosse case viewed a photo lineup of players one week after the alleged attack and did not pick out a team captain who has since been charged with rape, according to court papers filed today.

The March 21 photo lineup was made public by lawyers for captain David Evans in a motion demanding more evidence from the files of police and prosecutors.

Evans, 23, of Bethesda, Md., is one of three players charged with first-degree rape, sexual offense and kidnapping in the case. Collin Finnerty, 19, of Garden City, N.Y., and Reade Seligmann, 20, of Essex Fells, N.J. face the same charges.

The accuser, an escort service dancer, told police she was raped during a team party at 610 N. Buchanan Blvd. in the early morning hours of March 14.

It's unclear whether the woman identified any players in the March 21 lineup because defense lawyers did not receive a report on the procedure. In a lineup done on April 4, the woman picked out four players as possible attackers with varying levels of certainty. During the later lineup, the woman said she was "about 90 percent sure" Evans was one of her assailants, but said he had a mustache that night. Evans' lawyers have said they have photographic proof that Evans did not have mustache. Having a mustache is against lacrosse team policy.

For the March 21 lineup, Durham police used official photos of the lacrosse players, identical to those posted on GoDuke.com, the official Web site of Duke athletics. The police arranged the photos in groups labeled A through F.

Evans' photo was labeled F-5. There was a Post-It note referring to group F that said "Did not pick any".

Multiple lineups and team photos? These lineups are even worse than it was thought. This is fn' outrageous.

Amazing story isn't it? There were no non-team members used, they used the team photos, multiple lineups, no DNA, changing stories, 20 men, 3 men, bathroom, bedroom, slurs... it's a thoroughly ridiculous case moving forward for POLITICAL gain.

Actually, I think Nifong already had written himself into a new Jody Foaster movie. I think he saw himself as the courageous prosecutor sticking with the accuser all the way through all the tough times. Maybe he even promised the accuser, "This may get tough, kid, but I'll be with you all the way no matter what."

I also think that he was planning a she said/he said over whether the gang sex was consensual. I think that's why he was so over-the-top when the Lax players said nothing happened. That didn't fit the script he had in his head. He blustered, he tried intimidation a couple of time. They didn't budge. That's not in the movie either.

Then the DNA comes back and he realizes he is in a little trouble. The script still includes a severely injured accuser, so he isn't too worried, though. Then he has to do an ID and it doesn't get very good reviews from legal commentaters. The accused are claiming "alibi" instead of "she consented."

Now he is looking at a hopeless gap between his imagined defense of a wronged woman and his daydream movie script. His accuser is a whore, with tricks right before the party. There is a lot more evidence that the accused weren't there than that they raped anybody. The medical exam turns out not to be what Nifong had thought. Even proving sexual assault is looking difficult, much less linking an assault to the lax guys, much less to Seligman, Finnerty and Evans.

He is probably now realizing he can't stick with the accused through all the tough times. She lied, changed her story, embellished and otherwise totally trashed her own accusation. She is a prostitute with no reputation but a bad one, she has an implausible accusation and impossible alleged rapists.

We'll see how he goes about bailing out on the accuser he has allowed to destroy herself. With any luck, he'll go down the same tube that has already sucked in his accuser.

There is a ***rumor*** floating around here in Chapel Hill and Durham that a global settlement is in the works. This is why the defense is making rapid fire discovery motions, to increase the pressure on Nifong.

Key points of the rumor are:

1. Accuser admits drug and alcohol abuse clouded her recollection of events (flashbacks of prior 3-man rape) in a letter made public a day or two after she enters lengthy rehab. Social services takes over her case on behalf of her kids. She faces no charges if she completes rehab.

2. Charges against indicted Duke players are dropped.

3. No charges against boyfriend or drivers or Kim.

4. Duke party-goers plead guilty to various underage drinking charges and agree to community service and fines.

5. EVERYBODY signs a mutual release from future lawsuits and agrees to super-high liquidated damages if they talk or write about the case.

ALL OF THIS IS A RUMOR I HEARD FROM SOME LAWYERS IN A COFFEE SHOP. IT IS PROBABLY WISHFUL THINKING, BUT THERE ARE A LOT OF LAWYERS INVOLVED IN THIS COMMUNITY AND I AM SURE SOMEONE IS TALKING TO FELLOW, NON-INVOLVED LAWYERS.

Please don't flame me for putting this rumor out for FReepers to discuss. I have been a FReeper for almost 8 years and I generally dislike unsubstantiated rumors floating around, but this one may be an exception.

The only settlement I'd like to see is the false accusor in jail along with the crooked prosecutor. But I speak as an outsider.

If my son was one of the accused, I certainly wouldn't agree to that settlement. Complete exoneration, a public apology from the DA, and an arrest of AV for filing false charges would only start to rectify the damage done to these boys.
