This is never going to happen, at least not any time in the near future. Here in the real world the only way to change any part of government is to make the taxpayers so mad that they force the change through. The only way to make taxpayers that mad is to hit them in the wallet. It's not right but that's what we have to work with, unless you have a better suggestion.
True -- given the legal system as it exists, complaining about this lawsuit because the taxpayers end up paying for the damages is like complaining about the invasions of Afghanistan and Iraq because innocent bystanders end up in the crossfire.
Ultimately, better deterrents (e.g. my suggestion that victorious plaintiffs get to choose which government spending gets cut to pay the damages, buiding of stocks in the town square for public display of the JBTs responsible for the outrage, or whatever) are needed.
