HIV-positive man sentenced to 8 years for molesting two boys


ANGOLA, Ind. - An HIV-positive man was sentenced to eight years in prison after the parents of two young boys he molested told a judge their children face years of medical tests.

Bobby E. Lehner Jr., of Orland was sentenced Friday after pleading guilty to child molesting and vicarious sexual gratification in January.

The parents of the victims, described in court documents as two boys ages 6 and 9, became emotional as they told Steuben County Magistrate Randy Coffey that because Lehner, 34, is HIV-positive, their children face HIV testing for the next six years.

"That's not fair," one mother said, her voice shaking.

Another woman who said her child had been affected by the crimes said incarceration would be the only appropriate punishment.

According to court documents, Lehner was staying with a friend, the father of the two boys, when the acts occurred. After the father left the house, Lehner instructed the children to undress in front of him on one occasion, court documents said.

Lehner initially denied touching the children in interviews with police.

He told police he was a homosexual and had been viewing profiles of men online that contained nudity when the boys walked into the room.

He later told police he had been molested as a child and never told anyone, and had performed sex acts on the boys as a "learning" and "educational" experience for the children, court documents said.

The article talks about a lenient sentence by the judge, but where was the District Attorney in the case?

It seems to me there was room for a multitude of charges here.

Reckless endangerment, Child endangerment, Felonious assault

Obviously there was a plea bargain, but did the DA get a buy in from the parents before offering the deal?

8 years in Indiana:

2 days credit for every 1 day served with good behavior

Completion of substance abuse 3 phase program ( you need not be a substance abuser ) 1 year credit time

Were now down to 3 years executed time. There's also a community transition program that means either 90 days if its a C felony or 120 days if its a B felony credited as executed time, served as probation time.

Total probable time behind bars approximately 2.75 years.

Oklahoma recently became the fifth state to allow the death penalty for certain sex crimes, if they are convicted twice (which I assume means convicted on two counts)of rape, sodomy or lewd molestation involving children under 14 can face the death penalty.

They should have charged Mr. Lehner for attempted murder because he has HIV. If down the road, the children contract AIDS and die then he should be charged with murder.

There are states that have law on the books (such as California and New York) if you give someone HIV without notifying them and without the person can be charged with attempted murder. Mr. Lehner did not notify these boys about his HIV status. So he could be charged with attempted murder and it could add to his sentence.

If an HIV positive gives HIV without the other person knowing the status can be charged with attempted murder.

Many states have adopted more than one of these approaches. In most cases, the prosecution only has to prove the prohibited behaviour took place, and need not prove HIV was actually transmitted or even that the accused knew the conduct could transmit the virus.

Yet another example of the effects of diversity, tolerance, the big tent, room at the table, dialogue, debate, discussion, different points of view, human dignity, equality. This illustrates one of the reasons why society and the law at one time suppressed these people. I guess people will have to relive history. In the meantime great damage will be inflicted upon the innocent. People had better start considering the doctrine of self help. The present 'leadership' only encourages them in their quest for "Rights!" Now one can see what they mean by "Rights."

Okay, so lets sum up the situation here. We have a gay man, two young boys who have been molested by this gay man (although he claims he was wanting to do some 'other' guy), this gay man was molested as a child by another gay man.

I'm pretty sure there will be some spinmeister on TV explaining how there is no connection between child molestation and homosexuality and how homosexuality is a 'choice' and just overwhelmingly coincidental to childhood sexual abuse and not actually related to it. Blah, Blah, Blah.

The big SECRET is that YES most homosexuals have been abused as children. It is a learned behavior. The priests who were accused of molesting boys said that they were molested as children.

Homosexuality is learned and that is why the homosexuals want to control the curriculum in school. The younger the child, the easier they are to brainwash.

I am not condoning what he did - he should die in jail, but acts, not thoughts or 'gratification' should be the crime. This (second part) is a thought crime charge.

Was the dad that left the boys with the pervert really that clueless? I wonder if the parents are divorced. I wonder why the dad was living with a gay guy. Considering how often an estranged parent kills the kids to get back at the ex-spouse, I wonder if this was just a variation on that theme.

He should have gotten more then eight years. He was only brought up on two charges, but touched all of our 6 kids. He had been a friend of my man's for over 15 yrs and never told us he was HIV positive. The children were removed from our home and sent to foster care until he admitted what he had done. I am not happy with this decision, but what more could I have done I stood up and voiced my concern. They wanted to give him 1 yr probation. And How dare he say he did it cause of his bipolar. I am classified as bipolar and I have never touched a child in that way. This case has certainly changed me and my family. I am sorry but I just had some stuff I had to say on this case and had to get frustrations out.

No the father and Mr Lehner were not living together they had been friends for 15 yrs and occasionally Bobby would come stay the night with us ( he didnt have a vehichle) and we would take him home the next day. We had no clue he would ever do this or that he was HIV positive
