Supreme Court rules in favor of casinos (Wisconsin)

Casino gambling on American Indian reservations in Wisconsin will continue under a state Supreme Court decision released this morning.

The court declined to curtail the Las Vegas-style gambling that is currently legal on land held by 11 tribes in Wisconsin. Those tribes operate 28 casinos.

The widely anticipated ruling comes in the case of Dairyland Greyhound Park, a Kenosha dog track, which had argued that the Indian casinos were illegal because of a 1993 state constitutional amendment limiting gambling. That amendment clarifies that all types of gambling are prohibited in the state except bingo, raffles, pari-mutuel on-track betting and the state-run lottery. Casinos on the Indian land include slot machines, card games, roulette and craps.

Dairyland had argued that the amendment also applied to the tribes.

The court disagreed, saying "the state must honor its contractual obligations in their entirety." The court also affirmed the governor's right to renegotiate those contracts.

This rather remarkable 4-3 decision, which overrode a 2003 one that seemed to apply the amendment to casinos, is over on the SCOW website. Just as a reminder, Jim "Craps" Doyle (WEAC/Potawatomi-For Sale) appointed the author of this "no controlling legal authority" travesty, "Loophole" Louis Butler, to fill the remainder of the term of Diane Sykes (who took a federal judgeship). Combine that with the leftward lurch of Pat Crooks (unopposed in the 2006 spring election), and the Lawgivers-In-Black strike again.

At least there is a renegotiation provision in Wisconsin. Not so in Minnesota.

One that is 25 years down the road (except to extend gaming even further), and only if both the state and the tribes agree to renegotiate; otherwise, it continues in perpetuity.

The US constitution gives sole authority of dealin with the "Indian Tribes" to the US Congress. Any deals by states are not enforceable........

Tell that to Lawgiver-In-Black Barbara Crabb (Carter appointee IIRC), who told the state to either negotiate gaming deals with the Indians or have them do unlimited gaming a long time ago.

Governor for sale Jim Doyle was elected with Indian casino money. Governor for sale appointed Judge Butler to the WSC and Butler delivered the 4th vote on this decision.

Governor for sale Jim Doyle is up for reelection and has been assured by the Indian casinos that he will get all the campaign money he will need for his reelection. This money will be in addition to the usual trial lawyer money and union teacher money that Democrat governor for sale Jim Doyle will get. Doyle runs the state for the donors who put him in, not the citizens of Wisconsin.

Republicans have the legislature, but Doyle vetoes as necessary and has a veto proof number of Democrats in the legislature to back him up. Doyle will be known years from now as the Governor for life as well as the governor for sale.

Florida once tried to stop Big Money Bingo and cigarette sales on the Seminole Reservation and was told to go take a flying leap.........

Organized crime is behind this push for Indian casinos in virtually all states. Soon they will ban smoking, fight against slots in Non-tribal taverns, bars and gambling joints, then tap into the taxing structure of the state. It has happened in WA, they now are building malls, where they sell clothing, collecting sales tax and keeping it. Gas, where they collect gas tax and keep it, cigarettes where they collect the tax and keep it, I don't know about liquor, but I would bet they collect tax on it too. Then they buy up motels and card room type casinos (legal in this state) and petition to have it put within the reservation. Bingo, they can run "normal citizens" out of business with unfair competition, then buy them out and turn the formerly tax paying business into a cash cow. The city of Fife has lost a business that payed multiple millions of dollars yearly, a cardroom/casino/motel/restaraunt on a large property to the tribal black hole. Of course hardly a peep from those in govt that receive large contributions from the tribes, which by the way are exempt from McCain/Feingold election limits.

He'll not be "Governor for Life," but I do agree with your other statement. Wisconsin has never voted in a Democrat for a second term. I doubt Diamond Jim will do it. He's been the worst of the worst.

Like I said, when does something as "quaint" as a Constitution matter to a Lawgiver-In-Black, be they state (like the Gang of 4 on SCOW that just validated unlimited Indian gaming) or federal (like Crabb, who instituted this mess in the first place)?

I believe SCOTUS already ruled that Indian/state gaming contracts are "constitutional" (CB? Is my memory right or wrong?)

More Wisconsin history, Judge Crabb's decision was poorly written and on appeal was likely to be reversed or limited.

The party responsible to appeal it was the Wisconsin Attorney General Jim Doyle whose office missed the appeal date due to a "calendar mix up." Coincidence or was he bought years back?

Indian reservations are in many respects sovereign nations and state laws do not apply. Tribes in our area issue their own automobile license plates and fishing licenses and do not have to pay state taxes on cigarette or gasoline sales. State courts do not have jurisdiction on reservations and the FBI handles investigating most felonies.
