Woman Sues Bacardi After Alleged Injury From Flaming Rum

MIAMI -- A woman who was allegedly severely burned by flaming rum during a Bacardi promotion sued the wine and spirits producer, claiming the product was defective and dangerous.
Danielle Alleyne, of Miami, suffered horrific burns after she was hit by the flaming rum at a Miami night club in August 2002, according to the lawsuit filed Monday in Miami-Dade County Circuit Court.
"The burning rum stuck to her skin and continued to burn as she fell to the floor and tried to put herself out," the lawsuit said.
Alleyne suffered second and third degree burns on her face, neck, chest and back and is permanently disabled and disfigured, the lawsuit said.
After hours telephone messages left at the Miami-based Bacardi USA, Inc., were not immediately returned.
A bartender, who was not identified in the lawsuit, was pouring shots when a customer lit a menu on fire and placed it in the stream of alcohol. A bottle of Bacardi 151 that was being used to pour the shots turned into a flame thrower and sent flaming rum all over Alleyne, the lawsuit said.
A telephone message left after hours at the office of Robert Dickman, Alleyne's attorney, was not immediately returned.
The lawsuit alleges that Bacardi 151 proof rum "emits a high volume of combustible and explosive vapor" which makes it "unreasonably dangerous" and a "defective product."
Sue the bar, not Bacardi. That might go somewhere. Oops, I forgot, Bacardi has bigger pockets.

Oh good grief, thats what your PAY for! Was she sitting at the bar having a Pepsi? I can see maybe going after the bartender if he was an idiot about it, or the guy who lit it, but thats like suing Amoco if your car catches fire.
Once again, the stupid have to blame someone else for their idiocy.
That is all that needs to be said for rational people to understand fault here.
This guy should have been prosecuted for Attempted Murder in the 2nd degree..... Turning a bottle rum into a molatile(sp) coctail in a night club certainly shows depraved indifference.

Sounds like the customer should be sued, if not prosecuted criminally. Bacardi didn't do anything wrong. The drink did exactly what it was designed to do. When exposed to a flame and O2, 75% alcohol is gonna burn. This is no different than suing a gun manufacturer for a homicide.
I suppose bottles of booze are going to need MSDS's and NFPA warning stickers now.
Don't look for justice, logic or common sense in lawsuits. Bacardi didn't do anything wrong, but they have enough money to make it worthwhile as far as the lawyers are concerned and will likely settle out of court for a nice profit for the lawyers, and a little something for the plaintiff.

WRONGO - It was named by the Fins defending their lands from the Soviet invasion of the 1939 war. They called them the "Molotov cocktail" like when they were throwing the bottles "Here is another cocktail for you - Molotov!"

The title also seems written by a moron.
The way it is written the woman has only "alleged" injuries.
The word alleged should be used as such: "allegedy from flaming rum."
Oh good Lord! Any judge that lets this in his/her court should be summarily thrown of that bench!
