Marine Names Murtha in Defamation Suit

A Marine Corps staff sergeant who led the squad accused of killing two dozen civilians in Haditha, Iraq, will file a lawsuit today in federal court in Washington claiming that Rep. John P. Murtha (D-Pa.) defamed him when the congressman made public comments about the incident earlier this year.

Attorneys for Frank D. Wuterich, 26, argue in court papers that Murtha tarnished the Marine's reputation by telling news organizations in May that the Marine unit cracked after a roadside bomb killed one of its members and that the troops "killed innocent civilians in cold blood." Murtha also said repeatedly that the incident was covered up. (snipped)

I think it could be used against him if he got in touch with bootmurtha or Diane Irey. It is best if the matter is kept nonpolitical on the SSGT's side.

Not too many people know that servicemen and women cannot sue the government, and frankly I'm surprised that This Staff Sergeant is able to sue Murtha at all.

I can't remember any other time when a serving member of the military has ever had to sue a member of Congress for anything that congressman said.

That having been said, I have but one last thing to say......

Of course some will say that this kind of suit will have a 'chilling effect' on free speech. I say, "Bring on the ice"!!

I've been in favor of chilling speech since Howard Dean burst upon the scene 3 years ago.
