That's very true. I think the ACLU made sure this case would be in a friendly District Court in Michigan but did they think about the Appeals Court up there that has more Republican appointees than Dems?

Even a the dumbest Clinton appointed judges could see that these plaintiffs don't even have legal standing to be bringing this before the court. None of them have proof that they were targeted much less what the details of the program is.
According to Powerline, the 9th Circuit has already upheld the NSA position in a previous case. Every circuit that has addressed the issue has done so. So has the FISA court. The Sixth Circuit (which will hear the appeal) is one of the few that hasn't yet addressed it. That's probably why the ACLU filed the case in Detroit rather than San Francisco.
I expect that eventually SCOTUS will want to get involved. It can do so if the NSA wins on appeal, and is even more likely to do so if the court upholds today's ruling.
Unfortunately, given that five of them thinks that OBL's driver is covered by the Geneva Convention, I am not optimistic about the ultimate outcome. It will be a 5-4 decision no matter what it ultimately decides. That alone should tell you a great deal.
How does one judge's ruling on this matter? They have way too much power.
It won't be just one judge on the appeal. It will be either a panel of three judges or even the entire court.
But a single judge can bring it to this point, that seems absurd. Of course she has an agenda, appointed by that anti-American loon Carter. He probably encouraged this.
I give up. What is the great deal that it tells us?
The AlQaida terrorist is standing there holding a grenade ready to take the plane down and kill everybody.
The people's militia in the rear of the plane is ready to defend everyone at the risk of their lives and take control of the plane so the pilot can land it safely.
The ACLU ask the Judge to issue an instant order for the militia to cease and desist because to do otherwise might damage one of the AlQaida terrorist's rights.
So, at this point, the people's militia is faced with a real problem ~ that is, in this target rich environment, who dies first, who gets ignored, and who takes over the plane.
The situation we face in this war really isn't any different than that.
Fortunately for us, though, we have a President who doesn't care about the Left getting a PR victory, or even about being impeached by a bunch of nutballs -- he will continue this program and protect us all as he has for the last 5 years.
Sixth Circuit Chief Judge Judge Danny Boggs will demolish this Judge Taylor and her flimsy ruling. I can hardly wait to read his opinion.
The won't even hear it until mid 2007 at earliest. In the meantime, I assume they will stay the ruling.

That even lawyers and judges disagree strenuously on what the Constitution allows or does not allow the NSA to do. The left seizes upon a single wrong legal opinion from a single liberal, Carter-appointed Judge and treats it as "fact" that the NSA program is unconstitutional. It isn't a fact. It isn't even true. This case is yet another textbook example of how the political left uses the courts to accomplish political goals that it could never achieve by persuading the voters and their elected representatives.
