A Mexican man with two prior convictions for illegally entering the United States was arraigned in federal court in Cleveland on Wednesday for illegal reentry, the result of an investigation by Immigration and Customs Enforcement agents.
Jose Barron-Marquez, 35, a citizen of Mexico, was apprehended by the New Philadelphia Police Department after stealing a US flag and setting it on fire following a July 4th Independence Day celebration. Marquez provided the arresting officer a false identity, calling himself Marco Polo.
Marquez was taken into ICE custody July 11. Database checks revealed that he had two previous convictions for illegally entering the United States, in September 1994 and October 1999. Marquez was last deported from the US in January 2000 after he was arrested in Texas for sexual assault.
Anyone who believes they can violate the integrity of our borders with impunity should take notice, said Brian M. Moskowitz, special agent in charge of the ICE Office of Investigations for Michigan and Ohio.
Re-entering the U.S. after deportation is a serious offense. ICE will continue to seek prosecution against those who commit such crimes.
Marquez had his initial appearance July 17 before Magistrate Judge David S. Pearlman. Re-entering the United States is a felony punishable by up to 20 years in prison. Following deportation, there is an automatic 10-year bar from being able to re-enter the United States
The US Attorney's Office for the Northern District of Ohio has accepted this case for prosecution.

Let's see...... convicted & deported (AGAIN) in Oct. 1999.....and then ONLY three months later the scumbag is deported AGAIN, after a sexual assault in TX..........sheesh looks like only *citizens* get prosecuted/serve US jail time for sexual assault these days.

Since that's the excuse you hear so often, I say give it to them after ctaching them. Hard labor on the wall with cost of food & shelter taken out of their pay. After time served, back across border & if caught again on this side, 10 years minimum. The word would get out on the other side of the border that it's not a picnic here anymore. Now the message is "come on up, the pickings are easy"
