Suit Filed Against Ohio Voter ID Law

Columbus -- Labor and poverty groups sued to block Ohio's new voter identification law Tuesday, claiming that inconsistencies in how the law is applied make it unconstitutional.

"There's a significant risk here that tens of thousands of ballots will not be counted," said Subodh Chandra, a Cleveland attorney representing the group.

The lawsuit, filed in U.S. District Court, seeks a temporary restraining order on behalf of Service Employees International Union Local 1199 and the Northeast Ohio Coalition for the Homeless.

Chandra, a one-time Democratic attorney general candidate, said Ohio's 88 county boards of elections are inconsistently applying the new law in voting that is already under way.

The law requires voters to produce identification before casting ballots, but the boards are using different requirements for acceptable identification, such as military identification, driver's licenses and Social Security cards, said Chandra's co-counsel, attorney Caroline Gentry. She said voters also may encounter different requirements depending on whether they are voting absentee or at a board office.

Secretary of State Ken Blackwell, the Republican candidate for governor, has provided no guidance to clear up confusion, Chandra said.

Blackwell spokesman James Lee said the secretary of state's office has sent instructions to the county boards at least twice.

As a voter in Ohio who HAS identification, IS legally registered, and SHOW UP willing to prove who I am, I think I am gonna file a lawsuit for MY disenfranchisemnet, too.

For all the ineligible, dead, phoney, and multiple-vote Democrats that flood the vote in Ohio, my vote is being disenfranchised....

I would think the supreme courts decision regarding arizona would have put this issue to rest.

Don't you think they're just going for an immediate decision to enjoin enforcing the law for this coming election and then who cqres what happens afterwards? THis is a dumbocrat full court press.

Here's how you solve this problem:

REQUIRE that all voters provide a driver's license or state ID to vote. No EXCEPTIONS. If people can provide ID for any other government function for whatever reason, they can provide it for voting!

Election Day Procedures

Identification Requirements

Ohio voters are now required to provide proof of identity before voting. The form of identification that you may use includes your current and valid state-issued photo identification card, military identification, copy of utility bill, bank statement, paycheck, government check, or government document showing your name and current address. (Note: You cannot use as proof of identification a notice that the board of elections mailed to you.) If you do not have, or fail or refuse to provide, the required proof of identity, you may cast a provisional ballot.

R.C. 3505.18(A) Voters must bring identification to the polls in order to verify identity. Identification may include a current and valid photo identification, a military identification that shows the voter's name and current address, or a copy of a current utility bill, bank statement, government check, paycheck, or other government document, other than a reminder or a voter registration notification, that shows the voter's name and current address. Voters who do not provide one of these documents will still be able to vote by providing the last four digits of the voter's social security number and by casting a provisional ballot. Voters who do not have any of the above forms of identification, including a social security number, will still be able to vote by signing an affirmation swearing to the voter's identity under penalty of election falsification and by casting a provisional ballot. (The above requirement is effective June 1, 2006)

It looks like about the only form of identification not allowed is a not from your kindergarten teacher written on a napkin.

I am sure an ID is required for Social Security and welfare checks correct? They can use that same ID to vote.

I would have thought so, too. We can hope that whichever judge gets this has an aversion to being publicly smacked-down by SCOTUS.

Exactly. Heck, you need ID to get membership at Blockbuster or Hollywood Video! No one ever complains about the "hardship" of that! And funny how the same disinfranchised voters who can't provide an ID to vote can produce one for other times when they are REQUIRED to do so.

This is all about DemocRATS trying to steal the election. Disinfrachisement my foot!

I to am a voter in Ohio and feel exactly the same way. I would like to know what is required of individuals who are on welfare or receiving other state or federal benefits. I can't imagine we just hand out checks or aid without some form of ID.
