I understand his wife is very ill and that he commutes to Fla where she stays year round now...he was considering retiring last year to spend more time with her. If this is true, and he is moribound, how sad that he did not retire and spend quality time with her in their declining years.
I will say this. I do hope to see maybe another source break this rumor tomorrow. When a article has to mention a post on DU it sort of is a tad shallow. Also unless I missed it the phrase "off the record" or "on Backround" are used. Still, I shall have my eyes peeled

Even another Anthony Kennedy would be an improvement on Stevens.
Stevens is the most bitter, radical member of the court. Stevens would fit right in on the Florida or New Jersey Supreme Court, who make it up as the go. Or the 9th Circus Court of Appeals.
If the Dems took the Senate, they couldn't stall a Bush appointment 2 years. There are a few Dems who would vote with the GOP.
Ben Nelson D-NE, Tim Johnson D-SD, Kent Conrad D-ND, & Robert Byrd D-WV voted for Alito.
Other Democrats in "the gang of 14" are Joe Lieberman D-CT, Mary Landrieu D-LA, Daniel Inouye D-HI, Mark Pryor D-AR, Ken Salazar D-CO.
Only 22 Democrats voted against John Roberts.
41 Democrats voted against Sam Alito and 1 Republican, Linoln Chaffee.

Stevens smells blood of the Republicans now.
His handlers must have convinced him that he can finally fall on his pen after doing enough damage to the country for one man in one lifetime.
What if the democrats take control of the senate (god forbid) and both Stephens and Ginsburg resign in the near future leaving the court with 4 Conservatives 1 Moderate and 2 Liberals. Conservatives hold Bush's feet to the fire and he nominates two true conservatives. The new democrat senate then blocks the nominations in committee, says nomination's are dead on arrival etc. Bush responds by telling Democrat's basically "Screw you, these are my nominees, I'm not withdrawing them, either bring them up for a vote or the positions can remain vacant, and if you vote them down I'll renominate them or someone even more conservative."
My question is would this be plausible? Would a seven member supreme court have all the power as the full nine member court? Is there any time limit on when supreme court vacancies HAVE to be filled or could they remain vacant until Bush leaves office in 2009?

It's not only Stevens, it will also be Ginsberg as well. Mark my words.
1) There will be no Democrat majority.
2) This will be of no consequence to the House of Representatives, only the Senate which Rove has packed with RINOs.
3) Bush still needs to come up with a nominee more solidly conservative than Harriet Meiers.
I'd welcome Stevens stepping down but let's not get overly dramatic here.

If this does occur, first of all, let me wish Justice Stevens a healthy life for however long he is still here.
If this occurs, President Bush should nominate either Janice Rogers Brown or Miguel Estrada.
I thank him for his service to this country, as bad as it may have been, and I wish him a speedy retirement.
This is what it all comes down to. A conservative(read that constitutionalist) Supreme Court is now possible during this administration. it will be on now like donkey kong.
This is the 3rd source I have read about Stevens retiring because of ill health. And he is 86 years of age.
Yep, conservatives better get to the polls and vote for Republicans, so we can take back our courts.
I've heard this rumor before. He is so very old and hasn't retired yet. I bet he's determined to stay in that chair until they scrape him out...
