The overseas military ballots did not require a postmark anyway. USPS does not cancel (and postmark) mail that's sent postage free.

According to MSNBC at 7pm EST, there are now only 4000 votes separating them. Fox News claimed about 2000 votes.

A 4000 difference in the totals is generated by only 2000 votes.

I saw that, too. If the absentees aren't counted yet and won't even be started until tomorrow, this race is still on until they are.

Concede? Why? Who won? No one knows yet.

On ballots they do require a postmark. Navy ships have them postmarked right on board before they are flown home to prevent fraudulent ballots.

Update: 5% of Virginia precincts have not reported!

Latest numbers at 7:30 PM show only 94.81 percent of precincts reporting.

Who knows how many votes that represents. But, if all precincts were the same size (a big if), it would represent 124,678 votes remain to be counted if the total vote of 2,493.567 represents 94.81%. Of course, these could all be small precincts. But, even so, 5% still not reporting. Is it conceivable this could change the outcome?

Not only absentees aren't counted. They're still counting regular votes.

If you go a post office in person with a piece of mail, they will post mark it at the counter.

Maybe, maybe not. Those last few precincts were in very, very urban territory. Now, Virginia's vote history is pretty clean, but you don't mind if we complete our recount, do you?

What's the hurry, if everything is on the up and up?

Right, sure ~ the Domestic Mail Manual at the time of the 2000 election DID NOT REQUIRE POSTMARKS on any mail sent free of postage, to wit, absentee ballots sent by military personnel.

The Navy, for one, had not updated their DMM for nearly a decade and were working with old rules.

In fact, they didn't even have the regulatory updates that implemented Motor Voter (which occupies a nice chunk of the DMM if you kind of wondered who is in charge of it).

The State of Florida still relied on postmarks although federal law had changed to provide for free mailing for certain ballot materials (including military absentee ballots). Since Congress can pass and enforce laws concerning federal elections ~ to wit, President, VP, Senate, House ~ and they made those items free, other federal law, to wit, USPS Domestic Mail Manual, superceded the force and effect of the Florida law.

It was up to Florida to fix their law, not for the Navy to begin postmarking anything. If Navy is now postmarking stuff, good for them. Taking a quick look through the DMM I still don't see any changes that require postmarking postage free mail. Do you?

Kerry didn't bow out gracefully either. Bush had 120,000 vote margin in Ohio before Kerry decided he couldn't win it.

Allen should just accept he lost and get on with his life.

I read somewhere that the absentee ballots don't get counted until 2 days later, but after looking at the web site for the VA state board of elections, it doesn't look that way...they ARE counted the same day.

You answer brings up another question though. In 2004, I was in line before the polls opened and gave my name at the table at about 6:10am only to be told that I had already voted! You can imagine my surprise. I simply explained that wasn't possible since I couldn't have made it through the very long line twice.

Someone had to come over, I showed my voter registration card and driver's liscense again. I can't remember all the particulars. My question: Did my ballot become provisional at that point and was it possibly thrown out?

If you don't affix postage they won't postmark it.

The point is Kerry conceded the next day, and didn't keep the thing in the courts. He could have been a lot worse about it than he was.
