Let one of the liberals retire, Schumer can veto who he pleases.
If Bush is smart, he will send up another conservative, then another.
If the retirement is for a severe health reason, we would be in no hurry. Let the Supreme Court run for 3-6 months with one less liberal vote. Then see if the dems are ready to give in.

IMO, yes, that's not humble, you cant have the numbers needed to control the Congress without Liberal/Moderate Republicans from the blue states on the costs and the NE. Once you mention this on this forum hell brakes loose and fire breathing dragons come out thumping you death.

4-4 decisions are considered to uphold the lower court's decision. It would be perfect for the libs. All they would have to do is get some nuts from the 9th Circuit to rule one way or another, then the SC would have a harder time overturning it.

Not yet. Bush could recess appoint Justices after this congress adjourns in 2010. Those appointees would serve until 2012.
They'll hold out until the next election if they can.
I dont think its just democrats, I think there are republicans that wont vote for a conservative either. Snowe, Collins, Specter... are all republicans that already have given Bush two votes for conservatives, they probably feel like they dont owe him any more, especially since this would be the fifth vote to overturn Roe v Wade.
BTw I keep hearing all this talk about pro-life dems having just won, but the only one of the senators that I know of is Casey, Webb and Tester are both pro-choice.

USSC CJ Roberts comments before Judiciary that "judges are not politicans and can't make promises to be approved" was a brilliant volley, and a solid putdown of Schumer and Biden.
There were no SCOTUS appointments at the time.
Breyer is somewhat of a reasonable man, but I dunno why the party then caved in to Snoozing Ginsberg.
