Yu are confused. I never said anything about a prenup. My Mom didn't sign a prenup. There was never any mention of it! Besides she had more money at the time of the marriage (and my Stepdad's death) than he did!

It was stated in my late Stepfather’s will (he passed away several years ago) that she can live there until her death as long as she pays the taxes, insurance, upkeep, etc. and she is complying with the will.

Then how does your dead stepfather have a house that did NOT belong to your mother after their death? He could not give away something that was "theirs" by marriage, unless there was some sort of pre-nup agreement that is upholdable. Sorry, if I die tommorrow my vast fortune (ROFLMBO) belongs to my wife by law, I can not just rip her to shreads and leave her what both of us earned without a pre-nup.

Sorry, something is fishy to me.
