WASHINGTON -- Attorneys for a Marine based at Camp Pendleton charged in the killing of Iraqi civilians in Haditha want the U.S. military to look into the leak of an investigative report to the news media.
The Washington Post published photos and information from the investigative file this month that had not previously been made public, one showing five Iraqis sprawled near a taxi.
"This leak was inexcusable and unethical and very clearly presents a publicly unfavorable portrait of our client," lawyers for Staff Sgt. Frank D. Wuterich wrote.
Wuterich is one of two Marines charged with murder in the five deaths.
The lawyers asked Marine Lt. Gen. James Mattis to have the Naval Criminal Investigative Service find out who leaked the investigative report to the newspaper.
The impact of the leak, Wuterich's lawyers said, could taint the integrity of any court-martial proceeding.
The Haditha investigation stemming from the Nov. 19, 2005, killings is the biggest U.S. criminal case involving civilian deaths so far in the Iraq war.
If the Marines expect a prompt and thorough investigation by AG Gonzalez' DOJ, they are tragically mistaken.

Now what's happening is that "senior defense officials" have been leaking details about the case to the AP, Washington Post, and NPR. And it's been going on since late summer.
The latest, and most egregious, is the leak of the ENTIRE investigative report--thousands of pages of it--to The Washington Post last weekend.
Among the material were photographs. According to the WaPo, this was the most damning:

For "defense officials" to be leaking and interpreting photographic evidence is appalling, if not criminal.

On these threads, I've been touting the Iraq Marine Legal Defense Fund, Inc. Tim Harrington has created a similar fund to defend Marines and soldiers accused of crimes while fighting a war. His fund is called The Warrior Fund
If you click at the link, you'll see some of the work that they are doing. Tim is tremendous activist for justice. I got an e-mail from him tonight that read:

BTW, I don't see the Iraq Marine Legal Defense Fund, Inc. and The Warrior Fund as competitive. They all simply serve as conduits to the accused.
