Marine Lawyers Want Probe After Leak To Media [Haditha]

WASHINGTON -- Attorneys for a Marine based at Camp Pendleton charged in the killing of Iraqi civilians in Haditha want the U.S. military to look into the leak of an investigative report to the news media.

The Washington Post published photos and information from the investigative file this month that had not previously been made public, one showing five Iraqis sprawled near a taxi.

"This leak was inexcusable and unethical and very clearly presents a publicly unfavorable portrait of our client," lawyers for Staff Sgt. Frank D. Wuterich wrote.

Wuterich is one of two Marines charged with murder in the five deaths.

The lawyers asked Marine Lt. Gen. James Mattis to have the Naval Criminal Investigative Service find out who leaked the investigative report to the newspaper.

The impact of the leak, Wuterich's lawyers said, could taint the integrity of any court-martial proceeding.

The Haditha investigation stemming from the Nov. 19, 2005, killings is the biggest U.S. criminal case involving civilian deaths so far in the Iraq war.

If the Marines expect a prompt and thorough investigation by AG Gonzalez' DOJ, they are tragically mistaken.

Murtha called the Marines "cold-blooded killers" a year ago while the NCIS investigation was going on.

Now what's happening is that "senior defense officials" have been leaking details about the case to the AP, Washington Post, and NPR. And it's been going on since late summer.

The latest, and most egregious, is the leak of the ENTIRE investigative report--thousands of pages of it--to The Washington Post last weekend.

Among the material were photographs. According to the WaPo, this was the most damning:

The Washington Post caption read: "A photo contained in a Naval Criminal Investigative Service report obtained by The Washington Post shows a Marine inspecting a roadside scene near Haditha, Iraq, where five unarmed civilians were killed Nov. 19, 2005. Earlier that day, Marines stopped the white taxi in which the men had been riding, then allegedly shot them after a bomb exploded nearby. The incident was the first on a day of violence in Haditha that left 24 civilians dead, among them women and children. Four Marines have been charged with murder. For "defense officials" to be leaking and interpreting photographic evidence is appalling, if not criminal.

I think we should base the JAG corp outside the wire near the green zone... then tell me how many preventative measures or over reactions take place.... f'ing pussies...

every Marine is a rifleman first. pull point or get the f--- out of my fire team's way.

Anti-guerrilla warfare is the nastiest.... the propaganda war is where we're losing this thing. I'm for cutting loose the news media as well. Let them fare for their own.

I'm so glad that Hillary spent 24 hours and really has a firm background on counter insurgency as well as attack and maneuver small unit tactics.

I'd like to pose this question like the MSM questions President Bush...."Ms. Clinton, 'some people' say you are a fat a$$ed, lesbian, sociopath that is bent on taking our country down the socialist rat hole? What do you say to them?"

I spoke to a retired Marine tonight who'd agree with you: Timothy J. Harrington.

On these threads, I've been touting the Iraq Marine Legal Defense Fund, Inc. Tim Harrington has created a similar fund to defend Marines and soldiers accused of crimes while fighting a war. His fund is called The Warrior Fund

If you click at the link, you'll see some of the work that they are doing. Tim is tremendous activist for justice. I got an e-mail from him tonight that read:

I am currently working to expose the JAG and NCIS for what really has happened and why. The waters as you know run deep, and go up the chain of command to the highest levels.

I encourage everyone to have a look at the website.

BTW, I don't see the Iraq Marine Legal Defense Fund, Inc. and The Warrior Fund as competitive. They all simply serve as conduits to the accused.

It sure would be nice if the leaker is made known then charges are brought forth against them. This crap has got to stop somewhere. And that holds true for both side of the political arena as well as the middle.
The rule of law is being violated to such a degree in recent years by so many institutions it is totally pathetic.
