Ohio inmate with AIDS accused of performing sex act on sleeping cellmate

ELYRIA, Ohio — A state prisoner who has AIDS has been charged with performing a sex act on his sleeping cellmate at the Lorain Correctional Institution, a prosecutor said.
Michael Gross, 32, of Cleveland, was indicted on sexual battery and felonious assault charges. The felonious assault charge was filed because Gross has AIDS, Lorain County Prosecutor Dennis Will said.
The cellmate told officials that when he awoke Sept. 29, Gross was performing oral sex on him, Will said.
The alleged victim and Gross then got into a fight that brought guards to the cell and required both inmates to receive treatment at the prison infirmary, Will said.
Gross is serving a one-year sentence on drug and weapons charges from Cuyahoga County. He was moved to the Southern Ohio Correctional Facility, according to the state prisons department's Web site.
The cellmate was a 25-year-old man serving a one-year sentence from Summit County on drug and weapons charges, Will said. He has been moved to another prison, the Ohio Department of Rehabilitation and Correction said.
I think I would have probably also been facing murder charges if I awoke to that....
Maybe it's an obvious question, but did he actually think the cellmate was going to sleep through the whole experience??????
Hopefully the State will be sued for putting an HIV+ inmate in with HIV- inmates. Like it or not, the State is responsible for the safety of the incarcerated.
This is on par with putting a few rattlesnakes in with an inmate... just plain stupid.
This guy has virtually zero risk of contracting AIDS from receiving oral sex unless the guy was copiously bleeding from his mouth.
Nonetheless, the HIV positive inmate should be punished.

Lone Ranger and Tonto are out in the desert and a rattler surprises and bites Lone Ranger.
Lone Ranger is writhing in pain and can't ride his horse or walk. He instructs Tonto to ride into town and get the doctor.
Tonto dutifully does this and as it turns out, town is only a mile away, but as fate would have it, the doctor is busy helping with a difficult birth and can't leave with Tonto. He tells Tonto that a snake bite is not life-threatening if you just get the venom out quickly. But if you don't, the person can die within hours.
"You just need to make a small cut with your knife between the snake's fang marks and suck out the venom at the site. But hurry!" says the doctor.
Tonto quickly rides back to Lone Ranger, where Lone Ranger sees that Tonto uncharacteristically didn't bring back the doctor, per Lone Ranger's instructions.
"Doctor busy. Send Tonto with message".
Having been bitten by the rattler on his male member, Lone Ranger frustratedly screams, "Well, what did the doctor say?!?"
"Uhh. Uhh. He say you gonna die."

That is certainly true.
Punching an HIV+ person in the mouth would be even more dangerous: thin skin on knuckles, contact with teeth, likely blood, possible cuts to both fist and face.
Hell no. Now, a leglock would be a good option...a heel hook would be perfect; away from anything to cut/bite and there could be dislocation and shin snap.
Of course, it's best to stay out of prison.
