Lots of cases aren't black and white and clear cut.... That's the domain of the prosecution and defense attorneys to make the best of their case and let the jury judge the credibility and demeanor of each witness and piece of evidence...

Somewhere along the Appellate process we'll know more. It would be interesting to see the trial transcript but I've not seen it posted anywhere. Even then you don't have the flavor of the witness as they sat in the witness stand.

I still have trouble believing that the jury screwed the pooch on this one based upon some of the things that have been stipulate as fact in the trial proceedings. These guys compounded their problems with the cover up. And have now given rise to a suit by Aldrete which may or may not wind up costing the tax payers more dollars.

First of all they never ever did a cover up...They had their supervisors there...The penalty for what they did according to the BP regs was five days suspension...There was several agents there that knew that they had shot at the drug dealer...They never ever thought that they hit the guy and did not find out till a month later..All they had to do was make a verbal report but because their supervisor was there and he or she never asked for it...They did not do it...and they regret it but it make it seem like some big Clinton cover up took place and I am sorry that is not true.....What they did was a mistake and not a cover up in my opinion...From listening to Johnny Sutton he still claims that the drug dealer was shot in the back and the Doc who did the surgery said he was not...I do not like dirty cops but I cannot stand a lawyer who embellishes the facts to get a conviction...Like the Duke case...It appears your convinced they are guilty...Fine that is your right...I have been looking at this case almost since it first came out...The case is full of holes and Mr Sutton needs to keep his facts straight when he appears on tv...In my opinion he fails the smell test...

Concerning the trial transcript...

There are plenty of versions of what actually took place when two Border Patrol agents, Ignacio Ramos and Jose Compean, tried to chase down a drug smuggler in El Paso. But, unless you were there; unless you were present for the fifteen day trial; unless you paid $6,000.00 to read the 3000 pages of transcripts; unless you spoke with their fellow officers; unless you saw the affidavits from jurors who claimed that they were bullied into going along with the conviction, you cannot appreciate the enormity of this outrage.

$6,000.00????????
