Actually they are putting all their efforts into the upcoming Libby trial for....wait, it was Armitage that outed Plame. So the upcoming trial is for being Republican.

Berger's actions were designed to protect Clinton. Libby's trial is about getting a jury to endorse the Democrat mantra of "Bush lied" (to get us into the Iraq war). Naturally the DOJ is interested in helping past and future Presidents Clinton, and not in helping past or current Presidents Bush.
