Actually, we SHOULD abide by the Geneva Convention. Under the Geneva Convention, illegal combatants of this nature can be shot on the spot.
If we really would abide the international laws of war, EVERY captured insurgent/terrorist would be shot. They don't wear uniforms and they conceal their weapons... why the hell don't we put them against the wall?
