And why hasn't Bergler been indicted???

What would the new charges be?

As I understand it, he's already been tried, convicted, and sentenced. I'm not an atty, but I don't think he can be re-charged or re-sentenced - unless it was something new.

This whole thing really stinks and he'll be back in for Klintoon in '08.

As the media would like us to believe, he has been tried and convicted. But I don't recall any court appearances related to stealing classified documents, which is the crime in question here.
The concealment of classified documents in ones pants and the removal from the archives is strictly prohibited under law, regardless of careless intent.

Part of Burglar's plea agreement was to agree to take a polygraph test......as of yet, the Department of "Justice" has failed to make him follow through on it.

If DOJ would go after the guy who ordered Berger to do what he did, Berger would voluntarily go to jail. If anyone thinks that Berger acted alone in the doc theft, I have a nice bridge that may interest you!!!!!

I'm not an attorney but "Perjury" and "Obstruction of Justice" covers a multitude of sins and in this case, probably the simple truth.

Correct me if I'm wrong but I thought I heard somewhere today that part of his plea agreement was to take a lie detector test, which he has never taken. If he refuses to take it, I suppose his plea agreement become null and void. If officials simply do not require him to take it even though it's stated in the agreement, then that's a most sad state of affairs for this country.

The same as with Scooter Libby -- lying to investigators and obstruction of justice.

As I understand it, Berger made it seem like it was just sloppiness on his part. Now we know that he snuck documents outside and hid them under a construction trailer to be retrieved later.

He may have settled the original charges, but he should now be made to address lying to investigators, especially if his original light sentence was because of his lies.
