Actually, what I am suggesting is that if Earth continues to make space unavailable to ordinary companies, then perhaps profiteers may "fill the void."
Once a habitation is established, and defended, de facto recognition would appear to be necessary.

I knew I had to come back and check this thread for amusement. I must say I am NOT disappointed. Freepers have great senses of humor. :-)
All kinds of stories can take off from that point. A more interesting story would be how the habitation is established: not the technical aspect but status functions--how deontic instutional powers are activated.
I've got a story already started, perhaps a chapter or so, that can be bent to this purpose.
Starting a story is easy enough. Having a place to take it is quite another matter.
The situation is that we are stuck on earth for whatever of a dozen reasons including a worldwide conspiracy to keep us imprisoned as peons to the Illumanati. The Sturm und Drang would be the battle to get grudging permission to own property in outer space so investors would be willing to invest, and then meeting with investors, property deed in hand. The final chapter resolves the situation by at least a handful of former peons leaving earth. The settlement itself need never be developed except as pipedreams by rebellious peons.
Naturally enough, I take a slightly different tack. I'll send you a FReepmail sample of what I've written.
Heinlein, of course, paved the way. It will be difficult to tell a similar story without telling the same story.
