Judge Blocks Sale of Escort Client List

WASHINGTON (AP) -- A federal judge ruled Friday that a former escort service owner cannot sell phone records and other company records, saving about 15,000 clients from possible public embarrassment.

Deborah Jeane Palfrey, 50, has said she planned to sell the list to a news organization to help raise money for her defense. The alleged "D.C. Madam" ran Pamela Martin and Associates, an upscale escort service in the Washington area, for 13 years before it closed in August.

Federal prosecutors say it was a prostitution ring that yielded $2 million in assets, including cash and homes. In October, the federal government froze the asset

Judge Kessler was appointed to the United States District Court for the District of Columbia in July 1994. She received a B.A. from Cornell University and an LL.B. from Harvard Law School. Following graduation, Judge Kessler was employed by the National Labor Relations Board, served as Legislative Assistant to a U.S. Senator and a U.S. Congressman, worked for the New York City Board of Education, and then opened a public interest law firm. In June 1977, she was appointed Associate Judge of the Superior Court of the District of Columbia. From 1981 to 1985, Judge Kessler served as Presiding Judge of the Family Division and was a major architect of one of the nation�s first Multi-Door Courthouses. She served as President of the National Association of Women Judges from 1983 to 1984, and now serves on the Executive Committee of the ABA�s Conference of Federal Trial Judges and the U.S. Judicial Conference's Committee on Court Administration and Management.

Interesting. This seems to suggest that there might be a reversal of the opinion, which is based on asset-seizure rules rather than confidentiality considerations.

Gladys Kessler is an United States District Court Judge for the District of Columbia.[1] She was nominated to the court by President Clinton, a Democrat, and is known as one of the most liberal judges in the D.D.C. Judge Kessler was appointed to the United States District Court for the District of Columbia in July 1994.

Kessler is the first judge to consider an appeal that the Executive branch is violating the new Detainee Treatment Act.[2] Lawyers for Mohammad Bawazir argued that the measures Camp Delta authorities instituted to break a six-month hunger strike were abusive, cruel and unusual. Department of Defense spokesmen argued that the Detainee Treatment Act didn't apply to suspects held captive in Guantánamo Bay, Cuba.[3]

True enough, but this ruling makes perfect sense, anyways.

Those records are part of the assets frozen by the IRS, et al. If those are under the control of the government, you can't sell them - anymore than you can sell your house, etc, if the government's sold them.

I would GIVE it to some news outlet.
