Thanks for the poll info. I figure the judge is a typical socialist from northern Germany where this sort of attitude reigns. Thank God for the conservative Bavarians, the Rheinlanders, and the folks from Baden-Wuerttemburg.

Ok, I´ve to admit that I didn´t read the article, and assumed it was IPL. :) And I do have seen the spiegel.de site since my first post, too.

because both marital partners were from Morocco where the koran allows men to beat their wives, therefore there was] "not any unreasonable cruelty within the meaning of Paragraph 1565"

If law is based on nothing but convention, why not? Why not anything?

"If there is no God, everything is permissible."
--Dostoevsky

Legal theory has been separated from the natural law for some time. The consequences of this ideological shift are now becoming apparent.

She should "divorce" him with a shovel to the throat when he's asleep. If the State will not protect her, she has every right to protect herself.

That is far too painless. You are right that she should wait until he is asleep. Then double stitch sew the sheets to the mattress. When she finishes sewing the sheets all around the circumference of the mattress and no escape is possible she should wake her husband up by hitting him over the head with a baseball bat. He literally won't know what hit him. Then she can proceed to beat him to death. She will have no trouble hitting him. As he flails away and tries to escape his head will be clearly outlined and she can continue to deliver dozens of fatal blows to the head. As his bloody pulp nears unconsciousness she can explain why she is doing this. She should then proceed to breaking his legs, arms and rib cage. This will intensify his awareness. She can then at her leisure deliver the final coup de grace -- another 50 blows to the head. She should then mail pictures of his bloody carcass to his male friends telling them they had better sleep with one eye open. Then she better find a place to hide.

Sounds like too much work. The shovel to the windpipe method is quick 'n' easy.

It's a slow-motion train wreck, I can't avert my eyes though I want to.

No, it´s what we call international private law. If there´s no connection to German law, the German court must apply the law of the country with the most connections - in this case, Marocco. Strange, but helpful for foreigners who are unfamiliar with the local law.

Oh, yes... VERY helpful for foreigners. Especially those who are not interested in learning the local laws and customs, or making any effort to blend in with the rest of that society.

If a German were caught stealing in, say, Saudi Arabia, do you suppose they'd invoke international private law - or simply lop off the suspect's hand?

Stealing is a crime, not an issue of civil law. But if a German married to a German wants divorce in Saudi-Arabia, the Saudi judge has to apply German law. I´m not sure he knows that, though. ;-)

And regarding the actual case: it´s not a case of IPL, because the woman is a German national. So, the judge made a terrible mistake by using the Koran instead of the German constitution. The German public is outraged, and the judge was pulled off from the case. Many politicians call for disciplinatory measures and even the dismissal of her.

Not so fast Dick,

every German newspaper opened with this as a headline.
The content was about how outrageaous this is and why this means no good for our state and constitution - you name it they had it.

Who would have thought - our supposed to be left - media - made up today (all of them !) with articles about the islamification of our society.

that's new.
