House Bill 3317 would amend the law by making exposure illegal when it is in view of a place where another person has an expectation of privacy. How about simply making nudity illegal when:
- It is within view of someone who does not want to see it
- The nude person should expect that it might be in view of someone who does not want to see it.
- The person seeing it is has, or would have but for the nude person's actions, a reasonable expectation of not seeing that person, nor anyone else of similar sex and age, nude.
I fail to see what the observer's "expectation of privacy" has to do with anything. If the observer's lawn is completely visible from a public right of way, and the nude person is only visible from the observer's lawn and not from any public right of way, then I wouldn't think even this new bill would cover that.
