Nifong Issues Apology to Ex-Lacrosse Players

Durham — The local prosecutor who charged three Duke lacrosse players with raping a stripper apologized Thursday, acknowledging the decision of state prosecutors to dismiss all charges against them was correct.

"To the extent that I made judgments that ultimately proved to be incorrect, I apologize to the three students that were wrongly accused," Durham County District Attorney Mike Nifong said in a statement.

Not only is this not an apology, it is a rationalization/justification of his actions. He says, "I made judgments."

It is up to the jury to decide if the false accuser is a liar or is insane.

No, first it is up to the prosecutor to make a determination that the defendant can actually be convicted beyond a reasonable doubt. If the prosecutor does not believe it, it will never go to a jury because it will never go to trial.

Nobody elected ladyjane as prosecutor. It's not your call. The prosecutor has an ethical duty only to bring to trial those cases that they believe they can win because there is sufficient evidence to convict the defendant beyond a reasonable doubt.

The AG seems to think he cannot do so. I'm not sure that it is the AG's call. Technically, until the AG asserts a conflict of interest, the ball is back in the Durham county prosecutor's office. Technically at this point it is (amazingly enough) Nifong's call until he either recuses himself, the court recuses his office, the AG asserts jurisdiction or he is removed from office.

Michael B. Nifong took out a $106,500 Deed of Trust to the State Employees Credit Union on February 27th, 2007, per the Durham County Register of Deeds:

I doubt there’s two Michael B. Nifongs working for the State of NC in Durham, NC. I bet this is what he’s using to pay his attorney. There won’t be much left for anyone in a lawsuit. I would have thought he’d Quit Claimed his interest in the family residence to his wife by this time.

Yeah, I guess he himself won't need his present house, since he's moving to the "Big" one, but his family probably won't be too happy.

Well, the new word will be ‘nifong’! As in, “What the nifong?!”, “Don’t nifong with me, you mother-nifong!” and “Sharpton and Jackson nifonged Don Imus into losing his jobs!”.

You can bet the family’s last cow - that Nifong is hearing footsteps and feeling hot breath on his neck...

There is one mother of the accused, who is STILL not finished with him....

I sure wish someone could remember WHICH mother it was that PROMISED on television - Nifong would regret his actions for the rest of his life...

It was CLEAR, she MEANT it..and she has the cash and lawyers to follow through on her promise.

“Those kids are right. If this can happen to three people whose families can afford a combined 7 figure criminal defense lawyer bill, imagine how many people without these resources are sitting in jail as a result of similar prosecutorial tactics. It is frightening.

You can bet that ol’ Nifong has railroaded many in cases where the defendant couldn’t afford a good lawyer and the case wasn’t in the spotlight.

Rhea Evans, mother of Dave Evans, "Mr. Nifong, you picked on the wrong families" Quite prophetic, actually.

Does anyone know what the punishment for a false accusation is in NC? My understanding was that it was a misdemeanor. Even if the accuser was charged , she wouldn't serve time, just a fine.
