Howard K Stern files slander lawsuit

WEST PALM BEACH, Fla. Apr 13, 2007 (AP)— Howard K. Stern, the former attorney and companion of Anna Nicole Smith, filed a slander lawsuit Friday against an attorney for Smith's estranged mother who has suggested Stern was involved in Smith's death.

The lawsuit, filed in U.S. District Court in West Palm Beach, also accuses attorney John O'Quinn of invasion of privacy and seeks unspecified damages.

A telephone message left by The Associated Press on Friday afternoon for O'Quinn was not immediately returned. O'Quinn is representing Smith's mother, Virgie Arthur, in a custody battle over Smith's baby.

Smith died in February at age 39 at the Seminole Hard Rock Hotel and Casino. The medical examiner in the case ruled her death an accidental drug overdose.

According to the lawsuit, O'Quinn appeared on several national television shows in which he suggested Stern murdered Smith. During an interview in Fort Lauderdale, O'Quinn told Fox News Show's Greta Van Susteren that Arthur believed Stern had murdered her daughter and that O'Quinn agreed with her. O'Quinn also suggested on MSNBC that Stern had ulterior motives for wanting to see Smith's will days before Smith died.

"The public airwaves should never be used to promote personal agendas or vendettas," Stern's attorneys L. Lin Wood said in a statement issued Friday.

The lawsuit came days after a DNA expert revealed Smith's former boyfriend, Los Angeles photographer Larry Birkhead, was the father of Smith's baby, not Stern. Stern has said he would not fight to retain custody of 7-month-old Dannielynn. But Arthur is seeking visitation rights.

Smith gave birth to Dannielynn in September in a Bahamas hospital, days before her 20-year-old son, Daniel, died from a lethal combination of drugs at her bedside.

Meanwhile, legal wrangling continues over the estate of Smith's late husband, Texas oil tycoon J. Howard Marshall II, who died in 1995. It remains unclear how much, if any, of the $500 million Marshall estate Dannielynn might inherit and whether her guardian would have access to the money

I believe that Howard K Stern ordered these dangerous drugs for Anna Nicole, and that he should be in jail, and that he is the prime cause of the death of Anna Nicole. Those video clips show that Anna has seriously been on drugs for a long time, and Howard is an admitted provider. Without Howard K Stern, Anna might still be alive. He is complicit.

There's no way an ME can call something like that "accidental" with any certainty in a case like this.There's tens of millions of dollars at stake and there are two individuals who were either the "owner" of those millions or a presumptive heir to them who are dead under very curious circumstances.

Murder (times one or even times two) is a very real possibility.

A proper court would rule that slander Howard K Stern was an impossibility, like unicorns, and dismiss the case.

Anna was an addict. She would have found a way to get those meds. Believe me. of course Smith was an enabler. But did he WANT her dead? That’s what you have to prove and that will be pretty damn hard. After all, she was his meal ticket. Why on Earth would he want to end that?

I don’t get the Howard K. Stern hate. I think he is the closest thing Anna Nicole ever had to a real partner. I suspect that he did everything he could to help her because he loved her. When someone wants drugs, alcohol or pain pills and has the money to buy them, it’s very hard for someone else to completely keep them away. Anyone who ever watched the Anna Nicole show knows how determined she was to have her own way.

Even if he did manage her money, and I don’t know that he did, she would have insisted on having plenty of cash. She was the boss.

Howard drove off everyone who tried to get Anna off drugs. Her mother, Larry, both tried. In his testimony in Florida, Larry said he tried to get her off drugs, and in fact he hid them. It wasn't Anna that asked for them back, it was Howard.

Anna's son Daniel found himself on the outs with Anna when she moved to the Bahamas. He would try to call her, and Howard would answer the phone. He hung up as soon as he heard that it was Daniel calling. Daniel visited a private investigator to see about having Howard investigated. He said Howard was giving Anna "mind bending drugs."

Daniel finally gets to see his mom when she contacted him after giving birth. Daniel arrives and within hours he is dead. Howard kicked into gear destroying evidence. Ford Shelley said he saw Howard taking pills out of Daniel's pant pockets and throwing them out.

Several people have stated that they saw Howard give Anna injections in the butt. After Anna's death he told Dr. Perper that he knew Anna was an addict, and so he hid her drugs. The morning of her death, Howard said Anna was too sick to get out of bed by herself, so he got her up and assisted her to the bathroom, then left to buy the boat. The magical duffel bag of drugs that has been testified about was in the living room. For Anna to have given herself the fatal dose, she would have had to get herself out of bed, get into the livingroom, and tossed the room to find the bag, then give herself the dose and get back into bed.

I believe that she was too sick to get out of bed, because Dr. Perper said that she had diarrhea in the bed. I believe that charges will be forthcoming in the Bahamas. Then Florida will have to re-open their investigation based on evidence uncovered in the Bahamas.

As for the lawsuit Howard has filed against John O'Quinn, this is wonderful, and I believe it is what John O'Quinn wanted. He will finally be able to get Howard on the witness stand in this case and he will HAVE to testify. Remember, in Florida, Judge Seidlin wouldn't really allow Howard to be questioned because the judge had cut a deal with Howard. That will not be the case in this trial. If Howard wants to win the case he has filed, he must testify and answer the questions.

This reads like all the juicy evidence Nifong had against the lacrosse players and the media and most of the public couldn’t get enough. I don’t buy it.

I have read that Daniel had sought help from someone , saying that Howard K Stern had sought to control his mother. We will find this out at the hearing on Daniel’s death. Who would want him dead, other than Howard K Stern?

And why on earth would Howard K. Stern want him dead? So he can then kill Anna Nicole, get all the money for Dannielynn and then kill her too and have all the money for himself. I get it now.
