WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.

The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

5-4 decision. These decision are just too close. This is why it’s so important we nominate a conservative for president in 08 and not compromise on a moderate or liberal just because they are more popular with the media.

However, you must also take into account the mood of the USA outside Free Republic and the mood is as nasty against conservatives as it was against liberals after Jimmy Carter's term.

We have George W. Bush's inability or unwillingness to use the Bully Pulpit effectively to thank for that.

Rudy knows how to use the Bully Pulpit effectively and he is a Republican that would be a favorite to win in November.

A conservative that will go down to defeat in November in a conservative blaze of glory will get a hard core liberal elected that will pack SCOTUS with Ruth Ginsburg clones that will enshrine abortion as a Constitutional right for generations to come.

At least Rudy will nominate justices along more conservative lines.

In the end, even if Roe v. Wade is overturned, it will mean that abortion is a State's Right issue unless an Abortion Rights Amendment is passed.

From what I have heard, Rudy is fine with a State's Rights position and, since the liberals will never succeed in passing an Abortion Rights Amendment and conservatives will never succeed in passing an Abortion Prohibition Amendment, that is as good as it's going to get.

I don't know that "welfare babies" would be the problem. At least, on a conservative talk show around here, the complaint is about underclass mothers always having babies because their welfare allotments go up with each baby.

Exactly. babies=money

Cut out the gravy train and the welfare birth rate will plummet.

The UNBORN are mentioned. And the preamble states the parameters of the constitution. Therefore, it cannot be interpreted outside those parameters.

Actually, if you want to get down to brass tacks, the 14th Amendment supersedes anything in the "original" Constitution.

Which is exacly why this decision is significant - in the respect of giving the aborted baby some “personhood” that was stolen in the Roe v. Wade decision.

When you say "baby" do you mean a fetus or a baby that has actually been born? You may not see a distinction but the law does and always has.

Abortion was illegal (with criminal liability attached for those performing them) in every state until the 1960's. Up until then, the law made no distinction between a baby in the womb and a baby outside the womb.

But even if that were true, the law once made a distinction that allowed you to own an African. The exact procedure by which some evil bag of garbage in a black robe determines it should be legal to rip a small child limb from limb has no more bearing on this discussion than the evil that allowed people to employ Africans as automatic cotton-harvesting machines.

I don't care what the RINO's do. BTW, who exactly is not a RINO? I can't name any prominent elected republican that is fiscal conservative and in favor of a limited government.

The fact remains that the GOP gets out the message that overturning Roe is its #1 priority and it is in their grasp then the women voters in this country will give the GOP a severe beating in 2008.
