He has the right to be a prisoner, at least until the war is over. If he has also committed war-crimes, he has the right to *also* be prosecuted for them in a generally fair trial conducted by the military.

His criminality should not give him more benefits than if he were simply a combattant.

If he was caught actually in the act of fighting illegally he has not even that last right, and can be executed at will.

His criminality should not give him more benefits than if he were simply a combattant.
