Against the accuser, that's affirm.

Even agaisnt Nifong it will be somewhat of a challenge as the Duke three will have to establish "malicious prosecution" which is easier said than done. The cab driver who Nifong arrested on a two year old dismissed warrant will probably have an easier task of proving that, IMO.
