I’m not advocating incest by any means, but prosecuting a man for having sex with his 22 year old step-daughter, as creepy as that is, seems wrong, assuming this was consensual. I’m not even sure that’s technically incest in the first place. Would Woody Allen be criminally prosecuted in Ohio?

The rest of the story is that
according to the stepdaughter it was not consensual:
The stepdaughter told investigators that she passed out on the couch at Lowe's home following a night of drinking with friends in 2003 to celebrate her 22nd birthday. When she woke up, she said Lowe was having sex with her.
So the prosecutor probably decided that, rather than bring a charge of rape which would degenerate into a "he said, she said", he chose to bring a charge which he could objectively make stick, since Lowe admitting to having sex with her

Not in Ohio or anywhere else. Soon Yi was not Woody's stepdaughter and he did not adopt her. She was the adopted daughter of Mia Farrow and Andre Previn. Sometime after Farrow and Previn divorced, Farrow took up with Woody Allen (though they never lived together). Soon Yi was 22 when it was discovered she was having a relationship with Woody. They have been married since 1997.
