PHOENIX State lawmakers voted Monday to approve a law blocking the sale of anti-war T-shirts with the names of dead soldiers on them a measure one media lawyer says is "unconstitutional about three or four different ways."
The Senate agreed to make it punishable by up to a year in jail to use the names of deceased soldiers to help sell goods. The 28-0 vote sends SB 1014 to Gov. Janet Napolitano for her signature. The measure also would let families go to court to stop the sales and collect damages.
Dan Frazer, a Flagstaff businessman who is selling the T-shirts that caused all the fuss, said he doesn't intend to stop selling the $20 shirts even if Napolitano signs the measure. He said it's an illegal infringement on his First Amendment rights.

Simply listing the soldiers who sacrificed their lives for Iraq is, nor should be a crime.

Dan Frazer is a grave robbing ghoul. He's stealing the goodwill and sympathy intended for the fallen. He's an out and out bastard.
There were at last count about 6 months ago, 500 families at Fort Hood that did not want the names of their loved ones used in this manner. I hope one of them gets to spit in his eye someday.
What the media NEVER reported about Cindy Sheehan's Crawford gang at Camp Crazy was that over 75 of the crosses she set up outside Bush's ranch were picked up by a family mamber of the fallen and removed.
The Crawford Police and the County Sherif made the arrangments and accompanied the families they went out to Camp Crazy to do that. That the families of the fallen needed to be protected from the "peace activists" is an abomination.
The first parent who tried to remove their son's name had to go back and back and back before Cindy Sheehan stopped replacing that cross. And she wants respect for her loss?

This man may be a ghoul; but nonetheless, the right exists.
We either have a Constitution, or we do not. Either we have a Bill of Rights, or we do not. This man may be scum, but if simply printing a name is a crime; then we need to arrest every historian who ever put pen to paper, and then arrest those responsible for most war memorials in this great land of ours.

It's not illegal for a politician to push a bill that is unconstitutional. Maybe these politicians are just trying to make a statement against the shirt manufacturers.
I would agree if it was just some sort of statement but this has criminal penalties tied to it which means the taxpayers now have to pay to defend this in court and possibly attorney fees once it is struck down. It may not be illegal (even though members take an oath to defend the constitution) but it is irresponsible.

MLK is a publlic figure, but use his image without forking over the $$$ and you're toast.
We make it illegal to give out the names of rape victims, out of concern for their wellbeing. Why not the these families?
