They only have to touch base if they want to apply for a green card. They don’t have to go home at all if they just want a Z visa. And they are guaranteed a return once they do go home. This is more for appearance than anything else. It is a charade. And we must bear in mind that these conditions can be changed by Congress at any time. The Dems can change it once they take control of the WH in 2008.
Except they don't, since they can stay here on Z-visas indefinitely.
