Just curious, would the actions of the other local prosecuters be regarded as a conflict of interest when it comes to prosecuting others involved in drinking and driving?

I don't know if it would be a conflict of interest, but it's gonna be tough for DuPage county the next time there's a high profile DUI case- especially after some of the quotes by Birkett:
"I need to be forthright on this; Jane would have it no other way," Birkett said. "You can lead a great life and mistakes can be made."
"This mistake is human failure in its highest form," said Birkett, looking both stunned and solemn in a meeting with reporters outside his office shortly after he received the report. "She paid the ultimate price -- she's dead. That doesn't change the impact of what she has accomplished in the state."
Amazingly, Birkett apparently hasn't said anything about the woman who was hurt in the accident. Like, "I hope she recovers quickly", or something along those lines. It always amazes me when a politician or a news media person gets caught doing something wrong, and right away they claim it's a personnel matter and they can't talk about it.
