This is DR Tuberculosis we’re talking about. The government, most likely under the welfare clause, has the authority and duty to quarrantine this man. There will be more of this, rather than less.

No, he’s trying to go somewhere he can sneak away from to infect more people, like AIDS patients who want to “bareback”.

You sure? This is not the guy on the plane.

The government, most likely under the welfare clause, has the authority and duty to quarrantine this man. There will be more of this, rather than less.

I don't know if they do or don't.. and I don't object per se if they do. But, people shouldn't be thrown in jail at the whim of bureaucrats without being able to challenge it.

From reading the article this Daniels character is acting recklessly, both in refusing to follow medical orders pertaining to communicable disease treatment and exposure. So to answer your question, in the particular case, yes they should be able to detain you until your are no longer a public health risk. There is no evidence that there is an intent to detain him for the rest of his life, except of course it the TB is not cured before he passes.

If indeed his TB is not treatable as it seems to indicate is possible since they are looking at “last chance” treatment, do we give him a day pass to run to the mall one last time? I think not. This is one of those true “greater good” moments.

What sort of hearing would you like him to have? He acknowledges he has TB. He is contagious with a potentially deadly disease. Would you feel any different if he had the plague? He is entitled to due process of some sort, I suppose, but he is not being punished, he is being quarantined because he poses a health risk. Would you grant him bail at some price also?

The sad fact is that this guy has contracted a deadly, contagious disease. It may not be fair, but that is life. I am not sure I see how endangering others could be the proper response. Do I trust government? No, I really don’t. Do you trust this guy? He has demonstrated that he is not worthy of that trust. I’d say he and government are made for each other.

And as an aside, I do see where they are fighting for better treatment, not release, however since he is acting recklessly, I would fear anything less than the security of a jail would allow exposure. Perhaps they can get him a better cot, but I see no need for much else until he is more compliant. They are considering charges against him as well.

I think there is a big difference between theoretically quarantining a sick person, and putting him in jail. Now, if it is the case that unless this guy is in jail he will go out to crowded nightclubs and kiss chicks or dudes, then jail may be appropriate.

The ACLU is absolutely right. This man should be in a hospital. The police have absolutely NO right to hold this man without a trial. He broke no law.

This IS NOT the same man that went to Europe with DR TB. This is a man in Arizona who has been held in a jail cell for 10 months rather than taken to a hospital or a tuberculosis facility like a sanatarium

I am not suggesting he shouldn’t be quarantined, but there is not one good reason why he should be stuck in some prison. He can be properly quarantined in a hospital or proper medical facility much better.

this guy has not been charged with any crimes. He just got very sick and they threw in Jail

Let’s not forget, he was put into quarrantine because he refused to wear a mask in public exposure situations. Some of our “undocumented workers” have this disease also, which will be the next American epidemic.

Day to Day, April 2, 2007 · Robert Daniels is being held in a detention ward at an Arizona hospital because he is infected with a deadly strain of tuberculosis. Daniels refused to comply with voluntary quarantine rules.

Rene Gutel of member station KJZZ reports, and Dr. Ross Upshur, head of the University of Toronto Joint Centre for Bioethics, argues that isolation is the only way to contain dangerous types of TB.

...he suffers from an extensively drug-resistant strain of tuberculosis, or XDR-TB. It is considered virtually untreatable. County health authorities obtained a court order to lock him up as a danger to the public because he failed to take precautions to avoid infecting others. Specifically, he said he did not heed doctors’ instructions to wear a mask in public.....The ventilation system draws out the air and filters it to capture the bacteria-laden droplets he expels when he coughs. The filters are periodically burned. Daniels said he is taking medication and feeling a lot better. His lawyer would not discuss his prognosis. Daniels plans to ask for his release at a court hearing late this month.....Daniels lived in Russia for 15 years and returned to the United States last year after he was diagnosed. He said he thought he would get better treatment here, and hoped eventually to bring his wife and children from Russia. He said he briefly worked in an office in Arizona for a chemical company before he was put away. He said that he lost 50 pounds and was constantly coughing and that authorities locked him up after they discovered he had walked into a convenience store without a mask....the county would not force someone into quarantine unless the patient could not or would not follow doctor’s orders.
“It’s very uncommon that someone would both not want to take treatment and will willingly put others at risk,” England said. “It’s only those very uncommon incidents where we have to use legal authority through the courts to isolate somebody.”

He’s very sick and that’s horrible, but his own statement is that he doesn’t see the need to wear a mask. He is therefore a risk to all with whom he may come in contact and cannot be trusted to act responsibility.
He may be mentally ill or substance dependent.
