Seems to me like a facial violation of the federal civil rights law that prohibit discrimination based upon national origin.

Non-residents who are citizens of other nations are given preferential treatment, while non-residents who are Americans are denied that benefit.

At least out-of-state Americans are eligible for federal student loans; international students must pay out-of-state rates and are ineligible for practically all financial assistance, including private, credit-based loans.

The message: cross the border illegally, and you get discounts.
