For weeks, the White House and proponents of the shamnesty bill have been lying to us about what the immigration bill actually says. We should add back taxes to the list of subjects about which our elected officials are lying to us.
When it came out that the White House had asked that the provision mandating the payment of back taxes had been removed, the Senate's Most Annoying RINO assured us he would amend the bill to restore it.
Last night I pulled up the McCain amendment, which the Senate adopted early in this process. It is below, in its entirely. Note that it does not require the illegal to have paid a dime in back taxes to adjust his status. He only has to agree to pay.
It's also unclear whether this provision applies to everyone--i.e. applicants for Z visas and green cards, or only applicants for green cards. I can't determine if it's only the latter because McCain used page numbers instead of section numbers. He is obviously working from a different draft of the bill than anything I can find, so I don't know what section of the current bill is on his page 292. I will not be surprised if it is the section on permanent residency, making back taxes a requirement only of those wanting green cards. That is how it was originally. I have my doubts that this amendment would have passed if it imposed this requirement on Z visa applicants, whose representatives are already complaining that the fines and application fees are too high.
Finally, note that the back taxes are only "those for which the statutory period for assessment of any deficiency for such taxes has not expired." I guess that means only seven years of back taxes can be collected. So an illegal who has been here 14 years can get a green card by agreeing to pay only half the back taxes due. Once again, we should all be so lucky.

Mr. MCCAIN (for himself, Mr. GRAHAM, Mr. BURR, and Mr. SPECTER) submitted an amendment intended to be proposed to amendment SA 1150 proposed by Mr. REID (for Mr. KENNEDY (for himself and Mr. SPECTER)) to the bill S. 1348, to provide for comprehensive immigration reform and for other purposes; as follows:
On page 292 redesignate paragraphs (3) as (4) and (4) as (5).
On page 292, between lines 33 and 34, insert the following:
``(3) PAYMENT OF INCOME TAXES.--
``(A) IN GENERAL.--Not later than the date on which status is adjusted under this section, the alien establishes the payment of any applicable Federal tax liability by establishing that--
``(i) no such tax liability exists;
``(ii) all outstanding liabilities have been paid; or
``(iii) the alien has entered into an agreement for payment of all outstanding liabilities with the Internal Revenue Service.
``(B) APPLICABLE FEDERAL TAX LIABILITY.--For purposes of clause (i), the term `applicable Federal tax liability' means liability for Federal taxes, including penalties and interest, owed for any year during the period of employment required by subparagraph (D)(i) for which the statutory period for assessment of any deficiency for such taxes has not expired.
``(C) IRS COOPERATION.--The Secretary of the Treasury shall establish rules and procedures under which the Commissioner of Internal Revenue shall provide documentation to an alien upon request to establish the payment of all taxes required by this subparagraph.
``(D) IN GENERAL.--The alien may satisfy such requirement by establishing that--
``(i) no such tax liability exists;
``(ii) all outstanding liabilities have been met; or
``(iii) the alien has entered into an agreement for payment of all outstanding liabilities with the Internal Revenue Service and with the department of revenue of each State to which taxes are owed.
And, what will the government do for all those illegals who didn’t get their EIC for the past 7 years, hmmmm......?
IMO, McCain, more than likely, has been taking too many meds and its affected his two brain cells that are left.

Here’s more. This article is dated two weeks after the one you posted. Our allies in the House are talking about doing a blue-slip on the bill if it passes the Senate because of this very issue.

Uh, that's three years for any year that the illegal filed a return for, and six years where they did so 'fraudulently'. Not much for those who have been living here a dozen years or more...
What about state taxes? The states have borne the brunt of the costs, but even if the feds collect back taxes, the states don’t get to.
You know, I bet that when they “figure out their back taxes” they are allowed to take credit for the EITC, so they won’t owe anything.
