Duke prosecutor faces troubled future

RALEIGH, N.C. - His law license lost and reputation in tatters, Mike Nifong seemingly can fall no further. But the disgraced prosecutor who committed “intentional prosecutorial misconduct” in his pursuit of the Duke lacrosse rape case faces an uncertain — and likely troubled — future.

The falsely accused players and their families, having racked up millions of dollars in legal bills, appear likely to file civil lawsuits against the disbarred prosecutor. Their attorneys want a judge to consider holding Nifong in criminal contempt for lying to the court.

That probably won’t be the end. Shortly after Nifong was disbarred, Seligmann attorney Jim Cooney put it simply: “I don’t think any of us are done with Mr. Nifong yet.”

Cheshire said there is “certainly a significant probability” the players and their families will file civil lawsuits. While such lawsuits could seek damages from the city of Durham, the police department or the accuser, it is a certainty they would name Nifong as a defendant.

It’s not clear how much money the families could get out of Nifong, but the career civil servant’s financial disclosure statement suggests it isn’t much. His only listed income is his salary of about $110,000. Aside from his Durham home and some unspecified real estate in western North Carolina, Nifong appears to have no significant assets outside of any mutual funds and retirement accounts.

Personally, want to see him do a short stretch in jail to remind all prosecutors across the US they are infact not gods.

Only thing worse than being a child molester or a cop in jail is a prosecuter who tried to frame people...uh oh....

It was reported on friday that Nifong had taken a large loan out agains his home several months ago. I believe he saw the handwriting on the wall and committed fradulent conveyence of assets into a vehicle which he thinks is invilable in a lawsuit. They are not.

Let's see. He intentionally tried to deprive those boys of their Constitutionally guaranteed Civil Rights under the False Color of Authority.

Seems to me there's a Statute that covers that. Here it is:

TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnaping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Not that this Statute is ever actually used. My research indicates that prosecutions under this Statute are 'declined' by Federal Prosecutors an astounding 98% of the time.

But if ever a case cried out for such a prosecution, it is this one.

So in a perfect world, Nifong would be looking at a stretch of 3 years in a Federal penitientiary. And one must remember that there is no parole in the Federal system. So that would do for a start. Just a start mind you. I want to see this creep stripped of every dime he has now, or ever will have, in a Civil suit.

I would. RATS like Nifong place a great value on their own worthless lives, even as they regard everybody else as expendable for the most trivial reason.

I believe Nifong felt these loans to pay off his house would not be garnishable by a charge order of the court because they were protected. Fraudulent conveyance should be asserted and should win the arguement.
