The man responsible for the death of Tennessee State University senior is an illegal immigrant, police said Tuesday.
Joycelyn Gardiner, 22, died Saturday morning when a car, driven by a drunk driver, plowed into her car.
The driver, 24-year-old Victor Benitez, is an undocumented immigrant who has been in trouble with the law before.
On Tuesday, News 2 spoke exclusively with his roommate, Margarito Lopez, who said he knew something was wrong when he got a call from Benitez Saturday night.
"He told me that he got himself into some trouble,” Lopez said. “He told me he got into a car accident and hit a......woman, and she died."
Benitez is charged with vehicular homicide.
His criminal record dates back to 2003 in Houston, Texas.
Police there charged him with making and selling drugs and trespassing.
In Nashville, Metro Police said Benitez tried to steal three cars in Antioch in 2006.
Prosecutors involved with the previous case admitted their frustration with Saturday accident.

Gee, that was big of them. They should be relieved of their responsibilities if they did not prosecute him to the fullest extent of the law. And the legislators should be relieved of their duties if the prosecutors did prosecute him to the fullest extent of the law.
Is there a data base showing how many Americans have been killed by drunk driving illegal aliens?

Had there not been his Sanctuary City policy INS would have been notified when his jail time was up.

He should have been branded on the forehead and thrown back across the border at that time.
I live in So. California. The local newspaper in coastal Orange County lists the names of those arrested for DUI. The number of Hispanic names is well above their percentage of the population. They also account for an above average percentage of vehicle accident injuries and deaths.
It is a recognized fact that excessive drinking is more of a problem among Hispanic males. Just another benefit of Hispanic immigration, both legal and illegal.
