Mr. CougarGA7 of New Mexico introduced the following bill.
To promote the security of the American populous from unlawful entry into the country, correct unlawful hiring practices, and enforce existing immigration laws.
SECTION 1. SHORT TITLE; TABLE OF CONTENTS.
SEC. 1. Short title; table of contents (omitted to save space)
SEC. 2. COMMON SENSE
It is the sense of the American people that the problem of illegal immigration presents a grave danger to the population. The lack of security on the southern border is creating a threat both physically and economically. It is known that there is a significant cost to our social systems by supporting peoples in this country illegally without any significant return to the economy. Additionally, with an unsecured border it provides an easy access point to those individuals who wish to come into the United States with the intent of doing the people of this country harm.
TITLE I SECURING THE BORDER BETWEEN MEXICO AND THE UNITED STATES
It is the intent of this bill to provide the means to secure the southern border of the United States from unlawful entry.
SEC.101 SECURITY FENCE DESIGN FOR BORDER
A security fences will be erected along the 3141 km of southern border of the United States. This fence will extend from the coast of California to the Gulf of Mexico in Texas. The design of this fence will be based on the Israeli security fence constructed to prevent infiltration by Palestinian terrorists. A basic view of this design is as follows:
SEC.102 FUNDS FOR SECURITY FENCE CONSTRUCTION
It is estimated that this security fence will cost $2 million per kilometer of construction. Therefore $6.5 billion will be appropriated for the construction of the security fence along the United States-Mexico border.
SEC.103 FUNDS FOR SECURITY FENCE UPKEEP
Congress will appropriate in its annual budget the necessary funds need to maintain the complete integrity of the security fence. These funds will be used for general maintenance, repairs of any breaches, and maintenance or upgrades of electronic monitoring assets.
SEC.104 HUMAN ASSETS FOR BORDER SECURITY
The appropriate number of personnel will be retained for the patrol of the security fence. The number of personnel will equate to one person per 20 kilometers of fence on a 24 hour a day status to be deployed along the security fence in the configuration deemed most beneficial to maintaining border integrity.
SEC.105 FUNDS FOR HUMAN ASSETS
Congress will appropriate in its annual budget the necessary funds to maintain the human assets required by Title I Section 104 of this bill.
SEC.106 TIMEFRAME
The security fence and the appropriate personnel shall be completed and in place in no more that 2 year after enactment of this bill.
TITLE II RESPONSIBLE BUSINESS HIRING
It is the intent of this bill to promote responsible hiring practices by employers. This responsibility involves a genuine effort to avoid hiring those who are not legally in the United States and dissolving employment to those who are already working in the country illegally.
CHAPTER 1 HIRING PRACTICES
SEC.101 PROOF OF CITIZENSHIP
It will be the requirement of employers to ensure that those they hire are legally eligible to work in the United States. This will include the verification of Social Security number or legal work Visa.
SEC.102 COUNTERFEIT IDENTIFICATION RESOURCES
Resources will be made available to employers to assist them in detecting fraudulent identification. This will include training resources in detecting fake Social Security cards and work Visas.
CHAPTER 2 PENALTIES
SEC.201 GRACE PERIOD
Upon enactment of this bill employers will have a grace period of 12 months in which to detect and purge all those in their employ who are working in the United States illegally.
SEC.202 FINES FOR NON COMPLIANCE
At the completion of the grace period, any employer who is determined to be willfully employing or hiring persons who are not eligible to work in the United States will be fined. This fine will be equal to 3 times the salary of highest paid legally working individual in the same position as the illegal discovered over the timeframe that the illegal person was employed. If it is discovered that there is no individual working legally in the same job position then the fine will be 10 times the salary of the illegal worker over the timeframe that the illegal person was employed.
SEC.203 CRIMINAL PENALTIES FOR NON COMPLIANCE
If it is determined that an employer is willfully and repeatedly hiring individuals who are not eligible to work in the United States that employer will be subject to criminal prosecution for illegal hiring practices. The penalty for an employer found guilty of willfully and repeatedly hiring individuals not eligible for work in the United States will be no less that 3 year and no more that 7 years imprisonment.
TITLE III MEXICO ECONOMIC SITUATION
SEC.301 PRESSURE MEXICO TO ESTABLISH A VIABLE MIDDLE CLASS
It is the sense of Congress that increased pressure should be placed on Mexico to establish conditions conducive to a viable middle class in the country of Mexico. Diplomatic step shall be taken to encourage Mexico to improve the opportunities for Mexican citizens to advance and excel.
SEC.302 PRESSURE MEXICO TO ESTABLISH IMPROVED SOCIAL SYSTEM
It is the sense of Congress that increased pressure should be placed on Mexico to improve the social services it provides their citizens. This includes improving infrastructure along with improved security for the citizens of Mexico.
SEC.303 PRESSURE MEXICO TO DISCOURAGE ILLEGAL IMMIGRATION
It is the sense of Congress that the country of Mexico actively encourages its citizens to come to the United States as a means of supplementing Mexicos own economy. Therefore, diplomatic pressure on Mexico should be exercised to discourage the country from promoting illegal immigration into the United States.
TITLE IV OTHER MATTERS
SEC.401 ENFORCING EXISTING ILLEGAL ALIEN LAWS
It is a reality that there are already numerous laws already enacted concerning illegal immigration. It is the sense of Congress that steps be taken to actively enforce these existing laws.
SEC.402 DEPORTATION
At the end of the 12 month grace period outlined in Title II Chapter 2 Section 201 of this bill, any individuals who are apprehended and found to be in the United States illegally will be deported from the United States and will not be eligible for reentry for any reason for the remainder of that individuals natural lifetime.
SEC.403 ILLEGAL ALIEN CRIMINAL ACTIVITY
Any individual who is in the United States illegally and apprehended in the commission of a crime will be deported to their country of origin with the exception of cases where the crime is an offense eligible for the death penalty.
Add a tracking system for visa overstays.

That’s very much along the lines of what I’m thinking. The whole thing seems to come down to two specific things to me.
1. We need to secure our borders
2. We need to make in economically unviable for a company to willingly hire illegal aliens.
A third is enforcement of existing law with respect to crimes committed by illegals, and cities and states providing “sanctuary” in contravention of existing laws.
There should be NO guest workers program, but there should be a system for Sponsored Workers. If an American employer needs workers (if he/she prove they cant find American workers to do the job) they apply to government for a specific number of workers, for a specific period of time. On the other side of the border (wall) there is a list of people willing to work. The American employer will be responsible for health care, insurance, housing and transportation of said employees hired from outside the U.S. When the job is finished (the specific time frame is completed) the American employer is responsible for contacting the government agency and coordinating the return of the workers. Must have physicals, thorough back ground checks, and authentic documentation prior to entering.
That’s a different approach to handling temporary workers. I didn’t even put anything about that subject in this bill. We will have to ammend it in.
